My husband and I put in just under 20 claims between us on cards and 15 on loans in February.
So far he had an offer from Halifax (£5000) and a cheque for his CC within a couple of weeks of the claim - excellent service.
Last week I received an offer from Natwest (RBS) on a CC I had between 1992 and 2005 the only evidence I had of PPI was on one statement a payment of £6.50 my offer was £2000.
It is around 7 weeks since we submitted our claims and he had a rejection from Barclays on a CC saying it was a postal application and he ticked the box asking for PPI - he has submitted an appeal to FOS.
I had a rejection for a Lloyds CC saying there was no evidence of a mis-sale. This is even though I had other sickness cover in place including full sick pay from my employer, a critical illness plan, an early pension if I was unable to return to work and a redundancy payment which would have paid 12 months pay if I had been made redundant at the time of application. My policy was sold to me in the branch and I was told I had to take it to get the card. I have sent through documentary evidence to the bank to ask them to reconsider.
My husband is claiming on the basis of the number of pre-existing medical conditions he had which meant he would not have been covered.

With the rejected complaints, sometimes even on a final decision, they will review the case, depending on what further information you can give, so it maybe worth a shot, by giving them an extra 14 days to let you know if they will do this for you, if you hear nothing or nothing changes, then complain to the FOS.

Not sure about the regulated side as such really but yes, I would point out to the lender you have raised the complaint with them because the broker passed on the application without the PPI, where it was added by a staff member of FP and not them of the broker, and you remember this very clearly, (because you were pressurised into taking it out (if this also applies to you).
Time to email the CEO then with my complaint, cheers.0 -
Already asked for them, and firstplus say they have no phone recordings before 2005 so im out of luck there.
One last thing, my actual loan agreement is with Firstplus and the PPI is on the agreement, no mention of a broker on there either, so again this is why i find it strange that i should contact the broker not FP.0 -

The agreement will be that of the lender with no details of the broker, that is standard, but the actual completed application form should be the details of the broker.
It was the application in my case (completed by the broker) that shown no ppi was added, which helped my case, and as the agreement is that of the lender's, that is where PPI came into account.;)The one and only "Dizzy Di"0 -
Hi everybody
I have finally gotten around to PPI reclaiming: due to my financially naive younger days I have various credit cards with PPI premiums shown (I defo would not have opted to take PPI) and a loan from HSBC (signed up in branch, PPI fully front loaded and I did not realise it was optional!!!).
I am inspired by the posts I have read and will be keeping my fingers crossed for a good result!
I cannot find an address to write to for Capital One (cc) and was hoping somebody would take pity on the newbie????

Even though all the paperwork is FP the loan could have been done through a broker, you need to send the mis sell complaint to the broker and if they come back with a "no" due to the year you will have to go with the mis sell to the Insurer, if the Insurer says no the FOS may be able to help you from this point, you could be lucky and get the broker to pay up, but i would not consider court action against FP as if they did not sell you the PPI then you have no complaint against them, and you could end up with a legal bill for costs.
Asmy loan is regulated by the Consumer Credit Act 1974, i have done extensive research and found this.
If the PPI is sold by a broker the lender bears no liability for the mis-selling unless the credit agreement is regulated. In the case of a regulated agreement Section 56 of the Consumer Credit Act will often make the lender liable for antecedent negotiations by the broker.

I've been told over the phone that my PPI claim on two loans with Lloyds TSB hasn't been upheld and a letter is on the way. Both loans had PPI front loaded and for both loans we were never given two amounts to choose from (ie. payments with PPI included and payments without). We were simply told how much the payments would be and accepted them as basically, we were strapped for cash and wanted the money asap. We've always wanted to keep our outgoings as low as possible so have always spread loans over long terms eg. 5 years. We would never have chosen to pay something, effectively increasing our outgoings unnecessarily, had we known we didn't have to. We both have had the same employer for over 20 years with full sick pay etc.
My question is do we stand a chance with the Financial Ombusman or are we wasting our time?

I agree - to be honest I didn't state in my complaint that they were front loaded as I've only discovered that term since reading all the posts on this site which is after I made my complaint. Everything else I stated though - didn't need it, full year sick pay, redundancy package etc. I've been told to ask them to look at it again and give them 14 days to reply - I'll mention the front loaded bit but I'd have thought that they would have already taken this into account. I've no idea why I've been turned down as the letter hasn't turned up yet but once I get it I'll probably be on here for some more advice. I'm wondering if they turned me down as I was successful in getting bank charges back off them a few years ago and perhaps I'm 'black listed' with them now!! Who knows!Success so far:
