I recently complained to First Plus about mis sold PPI, my reasons were that i was told that if i didnt take ppi the loan would probably be rejected, also i was not fully explained about the 5 year cash back plan and that if i had been then i would not have taken the loan.

I took the loan out in 2003 Firstplus sent me a letter to contact the broker on the issue, although i contacted Firstplus and Firstplus only to get the loan and the loan agreemnet is Firstplus letter headed but they insisted it was brokered.

So i contacted the broker who sent me a letter saying they have no correspondence of me on their system, phoned Firstplus who said it was and take it to the FOS.

I complained to the CEO and immediately got help from Firstplus who through further investigation found that the loan was actually brokered to HFS who are now Capital One. So they have said to contact them with regard to the claim, again thuogh i have never had any correspondence wit HFS or Capital One.

So i am now going back to the CEO and will complain yet again and state that Firstplus were the lender and its up to them to chase any 3rd parties as it was Firstplus who took my money and gained interest on it, i am also willing to take legal proceedings and to take this to court if need be.

Do you think im right to do this

    Hi Di,

sorry, I'm getting confused with both threads. No letter today but hopefully Tuesday so I can get the ball rolling with the FOS. I've given more info on the other thread too!

Sounds like you've followed advice on here and written for original terms and conditions of your credit card. If that's the case and the Bank can't provide this, they'll have suspended (rather than "stopped") your account.
Contact them urgently and explain your reasons for requesting the T&Cs.
No need to contact the Ombudsman...

    Hi there

    I agree with Moneyineptitude

Do you know for sure you were sold PPI, if so and if you have reasons to make a reclaim, then you can still continue with the reclaim.
As on step 3, there is a reclaim questionnaire to complete and send to the responsible party who sold you the account.
Keep copies for your reference as well.

Not everyone has paperwork, but can recall on being sold ppi and have still made a successful reclaim.

    Good luck.

    Hi there

I know this can be confusing, but it's correct that whoever set up and sold the loan are the ones you pursue for a reclaim, so basically whoever undertaken the application with you - you go to them.

The lenders (who take your monthly repayments)despite the main of the paperwork will be their own, for the mis selling part of it the lenders will not get involved or chase up.

I note you have stated that you did not have any correspondence with anyone else besides first plus, but wonder if First plus can actually send you a copy of the application form in the post for you? (Tell them you require concrete evidence of this, as they must hold these details on file for them to have confirmed this with you.)
Maybe worth a try asking them to send this to you, as said above, the main of the paperwork will be that of the lenders, in your case FP, but the application should be details of the broker.
