I have already raised my complaint with M&S money and they have declined it as it was not covered by the FOS at the time. I have raised all the paperwork with the FOS and they have declined the complaint for the same reason but told me to pursue the insurance company Allianz which I have done. This has also been denied by the insurance companies so I have gone through the FOS aswell in August 2010. Every few months I get a letter from the FOS saying that they are still looking into my complaint. I have received another letter from the FOS as follows.
"We continue to consider the complex legal arguments involved. I am sorry, this is taking longer than we would like. But it is very important that we investigate thoroughly as we need to decide whether we are legally allowed to look into your concerns about the sale of your policy.
We will continue to keep you updated on our progress and we will write to you again by 30 November 2011."
Has anyone managed to claim against the insurance company vis M&S in the same way?
I still don't know how to progress with the above... I have re read the letter and have until the 2/03/2012 to reply.
The FOS are stating that they recommend my complaint should not be upheld as although there were shortcomings in the way that Allianz sold the policy to me they are not persuaded that I would have acted differently and would have taken the policy anyway...My defence was that the documentation was filled in by a salesperson in the store and I was told that I should take it out on the charge card and when I took the personal reserve out I took it out as I had done previously. Is there anything I can now do or say to help my case.I would appreciate any advice on this in any way as this is a substantial amount of money involved.
You could ask for this to go to the Ombudsman, as it will be the adjudicator who has rejected, the Ombudsman could reject too but you will not know until you try.0 -
The ppi monthly amount is in the monthly loan payment, you get back the ppi monthly payments you paid back with 8% monthly from the date of the first ppi payment to the date they pay the redress, this is on a decreasing scale as the nearer the redress date the less 8% you get.
The 8% is taxable and if not taken out by the bank you have to inform HMRC.
So.. if we have a loan starting on the 1/1/2000 and ending on the 1/1/2006 and the ppi complaint was was settled on 1/1/12 then the first premium on 1/1/2000 would get (12*12) 144 months of (8% / 12 (months)) 0.67 % interest?"I don't want to sound cold and un-caring, but I am those things so that's the way it comes out" - Bill Hicks0 -
Congratulations.
With your RBS claim would you mind tell me the reason you gave for mis-selling. I have a claim with mint/rbs currently sitting with the ombudsman.
I am so pleased!:rotfl:
Called Mint in late November to settle my account and noticed the PPI on the statement asked them what it was, they explained so I complained.today
Received a letter (was waiting for a letter from LLoyds) from RBS making me an offer of £5,138.91
Refund of Premiums £2490.68
Compound Interest on premiums £2069.19
Refund of erroneous overlimit fees £108.00
Interest at FOS rate 569.29
Less tax at 20% -£113.86
They took longer than 8 weeks to respond £19.51
Less tax at 20% -£3.90
Net Interest £15.61

I have signed and posted the acceptance form and now just waiting for the cheque to arrive!
That is what I call a RESULT:j

THANKS Amersall! I'm not being greedy I just want my money back to put in to Hubby's pension pot. He's NHS and looks like he'll have to finish at 60 leaving 6 years to state pension! This will be a little bit more to live off.0

Thank you.
Just told them that I had not agreed to this insurance, I had not asked for it and I didn't want it.
I was really shocked since I had never noticed I was paying this, I know this makes me sound airy fairy but in my defense I was too busy spending!
I hope this helps and hope you hear from them soon.0 -
two calls one to MBNA cancelled 7 years ago, other to Sandander cancelled 6 years ago. MBNA £3400 Sandander £7400. Both took just the one call each no paperwork. DO NOT use claims company unless you really have a need to. Go on it works. One was credit card PPI the other was mortgage PPI.0

Hi I take it the MBNA one was the Cedit Card. I'm awaiting a call back from someone after cancelling my PPI with them today. Can I ask how the conversation you had went? I'm not looking forward to the callback.

Hi everyone
Really need some advice girls / guys!
My husband has had 4 loans from 2001 with Yorkshire Bank. All paid off before 2010. One from 2001, 2003, 2005 and 2008.
He still has all the original loan agreements from all the loans each showing the PPI that he paid etc
Can he claim for the one's over 6 years old as he has the original load agreements?
(All loans taken with Yorkshire Bank)
Thanks0
