hi every 1, just received a letter from MBNA , witch i am confused, should i take it further,

    the letter says

thank you letter dated 4 february 2012 regarding the payment protection insurance policy, which you purchased to protect the repayments on you mnba credit card account, and for the information you provided.

our records show that ppi was applied to your account at your request on 23 august 2006. enclose a copy of your application form. please note that as your application was made online, the signature you provided was an electronic one.

during the internet sales process you experienced, information about pip appeared on a separate screen to your credit card application. it would have been clear from this separate screen that the pip was a distinct product from the credit card. in addition, you were offered an option to tick the box to purchase ppi . this option to tick the box would have made it clear to you that you could choose whether or not to purchase pip. given that you ticked the box, i am satisfied that you actively chose to purchase pip and understand that it was optional when you did so.

at the time the pip was added to your account, you were eligible for cover (you stated on your application form that you were a uk resident, in permanent employment and aged between 18 and 70). as you have not provided evidence you had any other adequate means of protecting your repayments in the event of prolonged sickness or unemployment, i have reached the view that. given for circumstances, the ppi policy you purchased provided you with cover which would have ben beneficial to you. i have seen no evidence of anything which would have changed your decision to purchase the ppi policy. on this basis, i regret to advise that i am unable to uphold your complaint or refund of premiums you paid.

do you think i should take it further or leave it alone? and ifso what steps do i take next? thanks dean

Was this their "final response" If not you could provide proof of whatever benefits you were entitled to through work ie 6 months full sick pay, 6 months half pay, any redundancy package and any death in service entitlement. If you had any of these this would have been a means of carrying on paying your payments and as such you may not have been eligible to claim on the PPI ;)
    Successes
    Sainsbury's/BOS £6,400 Paid :)
    MBNA £3,600 Paid :)
  • thanks again dilus you are good.
the answer to this one is that the debt company were paid off early last month once he had confirmation from them he started the ppi
    claim.
i am thinking that original loan company may be unaware that debt has been cleared .do you think that maybe right .
my son is going to make them aware of this by writing to them.
the other debt was paid off a good 3 years ago.

    thanks again
  • yes i think it was there last response , i only get normal sick pay and i do get full redundancy, but i i have other insurance to cover these payments .

Yes I'm just thinking how can they say the redress has gone to pay off the debt when the debt had been cleared BEFORE you put in your complaint
And as far as I am aware the debt was not with the bank, they sold it on to the debt company, so why should the bank keep it ?
I would get your son to question this like you say

Hi dean111, pity you never supplied them with proof of this in the first place, or just mentioned it may have been enough. You could FOS this with the extra information to back up your complaint but it's a long wait I'm afraid :( but worth a go ;)

Hopefully this wont take too long and you get the letter saying the loan is closed.

Hello, the Saga continues, No letter from LLoyds so as you suggested I called them. The lady was pleasant, we were on the phone for nearly 1/2 hour with her trying to get as much information from the Loans dept who apparently have completely screwed up the whole thing. I was told that her boss the PPI manager would call me at the earliest today up to 6:00 pm or tomorrow.
I am now eagerly awaiting the call, can't wait to hear what they have to say for themselves. Personally I think they made a mistake and the loan shouldn't have been paid off and closed, since if you do the maths after the cheque they sent for £5865 there is only about £4,900ish left (according to the offer letter) and my balance left on the loan was of £7000 +
If it is a mistake, me going on about it could work against me but I rather know and do things properly, sometimes dishonesty comes back to bite one in the derrière!:(

Hi, don't know if I'm asking in correct place so sorry if I'm not, just want a bit of advice as I have just started on my journey on claiming ppi, I have submitted claims to 8 cc company's but 4 have been done over the phone, I was not asked much detail as to why I felt I was missold, I just told them I don't ever recall being askied to wether I wanted the cover as I applied online for all cards, a couple before 2006, I also said I was in employment with sick pay so did not feel I would of needed the cover, I am now worried I will get rejected on the claims as I did not give much information, is it worth me submitted the questionnaire also to these company's or do I just wait to see what they say first, any ideas would be great as I am worried about these claims and really don't want to get rejected straight away, many thanks michelle

Hi Michelle, I wouldn't worry too much, don't think it's worth sending in a questionnaire for the ones done over the phone, although it might be worth filling in a questionnaire for each as you may have to go to the FOS with them at a later date and it would be worth filling in a questionnaire now whilst they are fresh in your mind. Don't read into that, that you might be turned down, lots of people submit complaints over the phone and get success with no issues. Wait to see what they come back with and take it from there. Good luck ;)

    hi LoopeyLuLu,

great news for you well done, May I ask, how did you do this? I have been on the Halifax web site and cannot find a claim form to fill and submit. Also what were the questions thay asked?

I hope you can reply as I think I may be too late to claim.......... thanks LuLu

    Hi amo333

Simply ring the Halifax as I did on this number, 08457 253 519

I did this on the 27th Jan 2012 and all you need to do is give them your name and the account number that you are claiming against and they will ask you the reason you believe you have been miss sold ppi then they will send you a confirmation letter of your complaint (I received this letter within 7 days)

On the 24th Feb 2012 I received a letter from Halifax which stated that they have upheld my complaint and I will receive £4700..:j

    Just waiting for my cheque..:)

    Good luck with your claim..
