  • We took out a mortgage in 2004 with northern rock and were given PPI part and parcel and we were told it was an essential part of taking out the mortgage but weren't told we couldn't claim for up to 60 days so its no use do you think we can claim it back?

Thanks, Amersall. Will the SAR show all transactions (ie any PPI payments taken/added) as well? Just wondering, if it's not on the agreement, where will it show me!

    You are welcome.
In the Sar you get all the info they hold on you, others who have had the Sar info will post to let you know what they got.
    This should include statements etc.

I have just recieved a letter from Capitol one in reply to my PPI claim, it says and i quote

Having reviewed the PPI claims charged to your account i can confirm that Capital One's offer is £154.69(premiums of £125.01,interest of£29.68 and £0.00 8% interest) in full and final settlement of the complaint. We are only required to offer the additional 8% interest when the account would have generated a credit ballance had PPI not have been charged,if we are not offering 8% interest this is because we do not believe your account would have ever been in credit had PPI not been charged.

Can somebody help me out and tell me if this correct and they are allowed to do this.

    Thanks Mick mc
With a CC redress, the card is reset, if the account has been credit when they reset this, you do not get the 8%.

looking for some advice. Took out a Firstplus loan in 2008 and recently decided to check online regarding reclaiming the PPI. I believe I was missold PPI insurance as when I was made redundant 14 months ago I phoned Firstplus to advise them and they told me that I was not insured and that only my partner (joint name on the loan agreement) was insured. I contacted Professional Personal Claims who have advised how much they can claim back for me. Has anyone had any success in reclaiming PPI against First Plus or has anyone used Professional Personal Claims. Or can you recommend another company to use? or is it easy to do the claim myself to avoid fees? Its all so confusing

DO NOT USE A CLAIMS CO FOR THIS.
    THIS IS A WIN.

A claims co will take a hefty % plus Vat on the whole of the ppi amount and not just what redress you get.

    Send this letter to FP
We/I believe we were mis sold the ppi on the above account number, and would like recordings,if any to the contrary of my/our reasons for mis sell set out below.

1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.

    2) We/I were told that the ppi was a 5 year policy, but not told the ppi would still be on the loan to term end with interest.

    3) We/I were told that if we did not make a claim,or go into arrears on the ppi ,after 5 years we would receive the cashback of ppi but were not told this would not include the interest made on these payments that we paid over the 5 years.

In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included. This will entail:
A refund of the monthly payments that have actually been paid towards the overall loan in excess of those that would have been needed, if the original loan had been sold without the PPI policy.

In addition, interest at the rate of 8% simple per annum to any excess payments made from the time each payment was made to the point that Barclays pays them back to us. We/i believe we were not given enough information on this ppi to make an informed decision. Had we/i known the full cost of this ppi we would not have taken it.

Unless you can prove without doubt that this PPI policy was fair, reasonable and suitable for my/our circumstance

FP are correct re the insurance, it is the first named borrower that is covered for all events, you are only covered for death.
Adjust the letter for you and send it off ASAP.

PS my fee is 0% and no Vat.

Hello, the Saga continues, No letter from LLoyds so as you suggested I called them. The lady was pleasant, we were on the phone for nearly 1/2 hour with her trying to get as much information from the Loans dept who apparently have completely screwed up the whole thing. I was told that her boss the PPI manager would call me at the earliest today up to 6:00 pm or tomorrow.
I am now eagerly awaiting the call, can't wait to hear what they have to say for themselves. Personally I think they made a mistake and the loan shouldn't have been paid off and closed, since if you do the maths after the cheque they sent for £5865 there is only about £4,900ish left (according to the offer letter) and my balance left on the loan was of £7000 +
If it is a mistake, me going on about it could work against me but I rather know and do things properly, sometimes dishonesty comes back to bite one in the derrière!:(
    Watch this space....[/QUOTE

    Hi Amersall

I did not get a call back, I had to chase them and still no letter about the loan being closed.
Got hold of the PPI manager who admitted that if looked like they had made a mistake and paid too much, this was now under investigation and he was not able to say anymore, I asked about the cheque and he though that it was best to hang on to it until this is resolved.
When I asked but why the lies about the letter being sent about the closure of the loan and he said "I don't know what to say".
When I asked what now, he suggested I call back in a couple of days, I replied you made the mistake isn't customer service courtesy to call the client back? I replied for him, you couldn't even return my call after I was promised that you would call back, what customer service!

I am glad I questioned this, like I wrote earlier better to be honest nothing like peace of mind!
Can't wait for the next chapter, they make it up as they go along, Cretins!
    Thank you for your help!:)
    You are welcome :D:D

    Go get em :cool::cool:

    Re: Black Horse Rejection

I've had a rather lengthy (3 x pages...double-sided!) letter from Black Horse rejecting my claim, following receipt of my questionnaire. They site many reasons why I may have been eligible for the policy.......which I can go back to them and argue the point that on the credit agreement there was no opt in OR out of the PPI, it was just part of the agreement they sent me (which I duly signed as we all did!) My query is, however that they state that during the time of the sale, they were not regulated by FSA (it was before January 2005) they go on to say if you are unhappy etc to complain to the Finance & Leasing Association, as the FOS are 'only able to consider complaints regarding policies sold by us between 1st Dec 2001 and 31 March 2003 and then from 14th Jan 2005'. Conveniently NOT for any time in 2004 which I took this loan out! Can anyone help with suggestions on how best to respond to them? Thanks x
Ring FOS and get confirmation of this, they will tell you what to do next if what BH said is true.

    Hello,

I have just rang egg and asked for the ref no for a loan I had with PPI on. Turns out I had two!! Both paid off, 1 paid off Nov 2003 and other 1 paid off Apr 2008. When I took these out I was told I could not have the loan UNLESS I took out PPI.

When I called they said they could raise the claim for me over the phone, which I did stating the reason above.

Now I did try and claim PPI back ages ago on one of the loans around 2007, at the time I was told I could not claim as they could not find the recordings of the phone calls??!!! So told me I had no proof.

    So my questions are:
1 - Have I done the right thing?
2 - Is what they said true, and if so are they likely to turn my application down now?

Thank you for your time in reading

A big big thankyou to everyone on this forum, without your posts I would never have bothered with trying to claim back PPI.
My story: I was ignorant of the fact that a Tesco Loan that I had once had, and paid of,f included PPI.
This bit is amazing -Tesco wrote to me last December asking me if I wanted to make a claim against them? Odd that, as I didnt approach them. I didnt have any of the original paperwork etc so rang them up and asked them to explain why they sent the letter.
They said that they had a team investigating old loans with respect to PPI payments and could see that it was possible that I was affected. During the conversation I told them that I would not have applied for PPI as being a Civil Servant I was exempt and they said they would investigate their files.
I have today received a letter saying the PPI had been added to the 'front' of my loan without my knowledge and they have offered me a settlement with interest and compensation!
Bloody brilliant as I would never have enquired further without their letter and this forum.
Thank you everyone and best of luck with your claims :T:rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::rotfl:

    HI Amersall.
Thanks so much for the information you gave me the other day, I have sent off my complaint and will let you know how it goes.
Can you just tell me, what does it mean by credit card being reset? Does it mean it clears what the balance is and whats left you get in refund?
I am so thick with these things, proably why I ended up in so much chaos in the first place. Trying to put things right though and MSE has been brillian.
