I had my response letter today regarding my complaint about mis selling of PPI attached to my MK one card.They rejected it for the following:
- Copy of agreement with 3 ticked boxes and my signature
- Sales staff, at the point of sale ,provide limited information i.e benefits and exclusions associated with PPI and this is then followed up with written documentation
- PPI is not a requirement with a store card it is the customers choice for extra security.
- Only concerned with age and employment status.
- Had opportunity to cancel as variable PPI amounts would have been on all monthly statements.
- whilst the copy does indicate 3 uniformly ticked boxes, it does not prove that I personally ticked them.
- If as alleged the sales staff provide limited information including exclusions at the point of sale, Then surely the fact that I was receiving incapacity benefit for chronic clinical depresssion may have been a red flag.
- If PPI not a requirement for a store card then why did the sales staff tout for the sale of said non requirement.
- Concerned with employment status- I was receiving incapacity benefit and had been for the previous 4 years
- Inclusion on the monthy statements does not prove the customers product knowledge and indeed does not prove that it was not sold to me in my best interests.
Sorry for the lengthy post. Any thoughts from you oracles out there.0 -
hi, i have heard nothing at all. still waiting and not bothering to hold my breath!
Chased up FOS this afternoon and they said that Opus would be writing to me with a settlement in the next couple of weeks. They had a spreadsheet and asked me if I would like to know the settlement figure they had (although they could not confirm this was up to date). The figure she quoted me was some £500 + under the amount I had paid in PPI as I have all the statements for the card, and would therefore not include any interest paid on the card.
She said that Opus would write with a breakdown of the figures and that I should contact FOS with any further info if I don't agree.
Also had a letter from Barclaycard saying that they were waiting for documentation to be retreived from a 2002 loan, (for which I had recently found paperwork, which I sent to them). I rang them as I had asked for details of this loan last year and they wrote and said that they no longer held any paperwork as too long ago. Amazing that it has suddenly turned up! They said they had a new system that could now link everything so I said they obviously got it since last July.0 -
Hi again, thanks again for your information. I have been through the letter templates and printed off some but before I send them and make myself look an idiot, can someone please tell me if what I have done is correct please. I have a credit card with both Capital One and Barclaycard, both of which I have no copy of the agreement but I also know I have been charged large amounts for late payments etc. So I have written to both banks asking for a copy of my original agreements (which I believe is going to cost me £1 per bank) and I have also used the template letter asking for a fully and comprehensive list of all default charges for late payments or going over my credit limit. which I believe is going to cost me £10 per bank). The addresses I have are Legal Compliance Specialist, Capital One (europe) PLC, Trent house, Nottingham. and for Barclaycard , Data Protection Team, Dept LRC, Northampton. Am I right so far?
Then I have closed accounts with HSBC, for A credit card, Bank Loan and Current Account. I have written to HSBC using the template letter asking for a copy of all data they hold on me for all accounts closed or current. which also asks to have included all transactions, agreements, notes made on my accounts and copies of letters relating to my account. I believe this is also a cost of £10. This letter is to go to HSBC Data Protection Controller at Canada Square London. Before Ipost these letters and make out the cheques I want to check that what I have done so far is correct. Thanks again0 -

I am looking for somce advice please.
In August 2006 my gf and I took out a mortgage with RBS for £90,000 100% mortgage. We got the mortgage though a financial advisor and becuase we were having a 100% mortgage we had to pay some form of insurance amount which was not said to be optional. This was approx £2500 which we put on top of the mortgage. So the total amount ws £92,500. The mortgage was a 2 year tracker followed by with a 5 year fixed and a poor 6.24%. We decided to stay with RBS so we never left them.
Today I have called RBS to ask for a statement from 2006 to see what the £2500 was for.
Does this sound like the mortgage insurance payments people have been claiming back?
Any help would be much appreciated.

I have had a letter from tesco saying n both loans they are offering a full refund, they have given me figures including an amount of £700 which is for interest, they state they will pay it off my loan arrears, should I be paid the interest.
They paid me the interest after the FOS involovment 2 years ago ( these are loans i thought they investigated at the time) would I have to go to FOS again or would they see they paid me the interest in 2010, and do the same now as surely the FOS would rule in my favour again?
Seems pointless Tesco taking it that far if they can see for the same person they paid the interest around 12 months ago

Hi once again many thanks for your response, but I am still at a loss with it all, because I don't know what I was asked, what boxes I ticked whether I was asked if I wanted PPI or anything, I had just seperated from my husband and he had left me with a lot of debt which I needed to clear up - that was the reason for the loan. My head was all over the place so I really cant remember anything, I suppose theres only one way to find out n that to try and see if I can claim anything back. Like I said previously I have no paperwork at all as when I cleared out the loft last year it allwent in the bin! I don't even have the account number for the loan only the last 4 digits and the date it was taken out and the date it was paid off and of course the bank in which I had the loan with. Same as my creidt card with the same bank all I have is the last 4 digits of the account number and the dates it started and it was paid off. ALso you mentioned a SAR - what is that? cheers
You could even put the claims in (look for reasons for mis sell) with the 4 digits,others have won on this site doing just this!.0 -

I tried to make a claim with my HSBC credit card for my PPi money back. I applied a very long time ago, and eventually my case was dealt with my the ombudsman who rejected my claim, saying that I would have needed PPI if I was ill and couldn't work. At the time I took out the card I would have had sickness benefits with the company I was working for, I don't recall being asked any questions about this at any time then since. It took 18months + to get this decision.
I worked for one company for 5 years with full benefits, another for 14 years and one for 4 years. I also took out a further private insurance policy to cover me for illness aswell.
First of all the bank/ombudsman kept trying to get me to provide paperwork for when I was given my credit card. I opened my bank account with Midland bank in 1985, around 1990, I then was given an account that gave you 2 credit cards (I only ever got one), guaranteed overdraft, few other options but I paid £5 a month for this. I have no paperwork for this and neither do they. I had previously had a loan and they receommended this type of account as it would guarantee that I would be able to can a loan quicker, if I ever needed one again. I just filled in a form and handed it over the counter they did the rest. This £5 was on my account for along time until they stopped having that kind of account. I wasn't even told it was stopping I just noticed that the charge was no longer being taken each month.
I was made redundant in 2009, but as I wasn't on JSA I couldnt get a payout on my ppi insurance. I continued to pay my account as normal.
I feel that I have been fobbed off by HSBC & the ombudsman, especially as I have had payouts from Halifax & Santander. Is there anything I can do about getting my claim re-looked at or do I just have to except this decision? Also if I wanted to re-appeal is there a time period in which this would need to be done.0
