Hello to every one on the Site and thankyou for all the advice very new to this but here go's. I have had a number of loans with welcome fin, I have sent them all forms on jan 6 and had claims upheld. The thing is that I had to send off to aviva for 3loans as they were before jan2003, I have received letters back from them saying there are not in a position to investigate because the pip was sold prior to the date on which aviva became insurers for welcome finance, so they have now closed the file. Been back in touch with welcome and they say can't look at any thing before jan2003. Is that it for me now do I just leave it,or can I do any thing else?? I have all acc numbers and policy numbers. And once again a thankyou to all as I have already had complaints upheld from welcome but any help please.0

Get back to them and tell them you dispute the rejection of the claim on the grounds "you did not have ppi" as they have no paperwork for these loans, how do they know this? and you would like them to send you proof of "no ppi".
Thanks for this Amersall. I telephoned Lloyds TSB on Friday and they said that letters had been sent to me on 26 January. I have not received them. I have requested copies. You said that I should write back and dispute the rejection on the grounds that I did not have PPI. Will they reconsider my case? When I requested copies of the paperwork from Loans Direct, they advised me that they did not hold letters before 2000. All three loans were from the 1990s: two from 1995 and one from 1999. Instead of having an account beginning with 1000 the loan number was linked to bank account and sort code: 87 XX XX 7XXXXXXX. If they cannot provide me copies of these agreements then how can they possibly say that I had no PPI? What proof could they possibly send me to justify their claim that I had no PPI? I am really disappointed in this and especially so when I have read on this forum that people are getting paid £1200 payments on proof of loan account numbers and dates. I had all that. I even sent a print-out of the loans given to me by my branch in Scotland. Thanks again for your support. Right now I feel totally disgusted with them.0 -
We kept getting plagued by calls from PPI companies offering to fight our PPI battles for us, but kept just assuming it didn't apply to us as we wouldn't be that stupid to pay all that money for insurance. Then one day my fiancee had a chat with one (against my wishes!) and they told her to get copies of the agreements for the 2 loans we had.
When I rang Halifax for copies they asked if I wanted to make a complaint for mis-selling, which I said i did. They then said they may call to offer a settlement. They asked on what basis I was making a complaint, and I just said I didn't think I would have agreed to pay that much for insurance (24%).
After speaking to my fiancee, it turned out that the PPI company wanted 39% of any payout!!!!
Within 3 weeks Halifax had supplied the agreement copies and T&C's of the insurance, and written to say they would payout the full amount £1500 + £500 of interest at 8% totalling £2014 for loans totalling £6000. We received the cheque within 3 days and obviously the PPI company didn't see a bean!!
We didn't even have to write a letter!
Thank you Martin, and great informative video.0 -

hey can you advise me i am in a repayment plan to pay off my debt with the bank i have had a letter from them saying that they are due to give me 9,300 in missold ppI but it says on the form that they can take off any arrears. Does this mean although i have entered into an agreement with them to have my interest stopped and pay what i can, (i am paying my debt off eventually) does this mean they can take this sum and put it to the money i owe them.
If you are in arrears, they can use the redress to to reduce the debt.
Which bank is this? you may get the redress to you, unless they show what they have applied the redress to.
They have to give you the 8% payment though and this will be taxable if you are a taxpayer.
When the redress has been done and whatever the amount taken off loans, make sure the balances go down by the ppi amount, then you ring them up if you have any remaining balance, and agree another arrangement for the payment if you cannot afford to pay the full monthly amount.
If these are credit cards, ask for the same arrangement you had before for any balances that are left.0 -

Ring the FOS and ask if this is correct, you should be able to go for the insurer,Aviva may be trying it on.
