Hi, I'm new to this but i'm really hoping someone can offer me advice or maybe experienced something similar.
I was always aware that I had ppi on 2 loans going back 8 and 10 years. At the time, I was told that I would be refused the loans if I didn't take out ppi. 9 weeks ago I filled out the template letter and sent a request to the bank, last week I received an offer of almost £2400.
Sounds all very simple but while the bank have offered me 8% interest along with the offer, I should be receiving almost £3500. But the bank are only offering this to me on the grounds that according to them ppi was not misold on either loans but that instead of a one off ppi, a monthly paid policy would have suited my circumstances better. They didn't offer this at the time but if they had, it would have only cost me £1055. So they took this off the offer, hence my offer being£2400.
How can they offer me a refund and then take off a figure for a policy that they didn't offer?
I have 7 more days to accept or they have told me to complain to FOS.0 -
rang Halifax at the beginning of December, got a letter today stating they will be sending me £4200 for 2 loans and a few credit cards. Not sure how long I have to wait for this to arrive though!Became Mrs Scotland 16.01.16

Just had two more upheld this week from Barclaycard expecting the last one today also
Barclaycard egg £8k
Barclaycard Gold £699 Going to question this one tho as the interest is low at £71 on payments of £545 + 8% simple interest of £82.00 IMO.
The total i have got back now i circa £22k plus fingers crossed the biggie today been paying over £100 per month ppi on this one.
To be honest MBNA were fntastic and Barclaycard very good too so cannot complain all for an hour filling in forms and £6.00 of stamps !!

Hi there,
I have just found out details of 3 loans going back to 1994.
I think the first one was approx £1000/1500 over 12 months.
I then took out another loan a year after this, and same again the following year. Again, I think they were for approximately the same amounts over 12 months.
The bank cant find find copies of the loans agreements, only the account numbers so they cant confirm if I had PPI or not. I think I probably did as I was only about 20 at the time and these were my first loans so I was quite naive and would have accepted whatever the assistant told me. However I didnt realise I have full accident/sickness cover with my work at 6 months full pay then 6 months at 75% pay along with a full redudancy pay.
My question is, have I been mis-sold? What are my chances of getting anything back?0 -

Just had a call from FOS, they've rejected my claim against Capital One. They've had nothing from Capital One to suggest I checked an opt-in box but think I would have taken it given my circumstances at the time (thinking back on this I find it more than a bit condescending)...
I've got 2 weeks to appeal.
Any advice? Anyone else had success against them with an online application?
I guess I have nothing to lose by appealing but from reading through posts I doubt I'll have much luck.
Capital One seem to do well fighting PPI despite the company's inability to sufficiently hold any written or phone records to defend thier case.
Also, a bit risky of the FOS to actually make the suggestion that you would probably have taken the Insurance due to your circumstances at the time - more than a little presumptous! :eek:
Capital One should be providing the FOS with the evidence used to defend the decision to refute your claim - if they cannot then how can the FOS acquit them and assume you are then wrong?
