Just had a call from FOS, they've rejected my claim against Capital One. They've had nothing from Capital One to suggest I checked an opt-in box but think I would have taken it given my circumstances at the time (thinking back on this I find it more than a bit condescending)...
I've got 2 weeks to appeal.
Any advice? Anyone else had success against them with an online application?
I guess I have nothing to lose by appealing but from reading through posts I doubt I'll have much luck.
Refuse FOS findings and ask for this to be passed to the ombudsman,what were your circumstances at the time,and what reasons did you use for mis sell?.0 -

My wife and I have recently cleared all our debts after a six year debt management programme and selling our house, and I figured there would be no harm in trying to claim back against Halifax for two loans that I had which dated back to 2001 and 2004. Just had two cheques from them or £7250.33 and £4642.79 respectively, and all I did was fill in the questionnaires on their website after seeing the stories on here. Nearly £12k from two loans! Thank you so much, MSE folks - I'm in absolute shock! Going to have a look at all our other loan agreements now - didn't bother because I doubted I'd get anything back before.0

Noted that a lot of claims are from other Banks etc. But have yet to see if anyone has had any success with First Direct. We have PPI going back as far as 2003, no idea what success we will have in getting any of it back.

Hi, i'm in the process of claiming back PPI from the halifax, for a credit card i had in 2007. I sent the claim in on the 30th November and had a phone call asking questions about my claim on December 6th i then had a letter saying they were looking into my claim and have until the end of february to make a decision. Has any one else tried successfully or not to claim back from the Halifax. I'm just wondering what my chances are?
I've also found an old statement today from a Alliance and Leicester loan i had so have just emailed them too.... will keep you posted.Debt BCC £7257,POCC£2322, Next £769, Loan £6131

Who was the provider: egg(barclays)
How much did you get back: I got £3,826
And then write your brief reclaim tale :
Submitted a claim to Egg on 5 October 2011 about mis-sold PPI on an online credit card application form from 2003, because the form was pre-ticked. Received follow up to say it had been passed over to Barclays. Just received an offer of £3826 which I am happy with. I don't think it includes the charges I incurred each money for going over my limit so will ask them to calculate including - probably pushing my luck but worth a go. Thanks so much to everyone on the site for posting help, guidance and experiences. :j0 -
Brilliant news, I've sent my letter to them yesterday...fingers crossed. My online application was feb 2003 and I have also claimed pre ticked boxes, did you have any other reasons to support your claim..self employed etc??0

I rang the ombudsman regarding the GISC,and you are right they
also said that i should write to them and remind them that they
were a Member of the financial banking of the ombudsman,right
back to 1992 and before,by reminding them about this it just
might make them re-think their reply,he said if and when i get
a final response he would be very happy to take this on as ive been
tackling them since August 2011,,if anyone else has an excuse about
barclays becoming a member of the GISC,and cant look at claims before this date,i say ignore it ,,its a FOB OFF..I have written them
a letter and will wait for my last response,and let you guys know
