    Amersall many thanks.
Yes they do know its a woolwich loan,i had a 1hr 10 min phone conversation, with them,i have asked them to give me a final
response, and i have already got the forms from the FOS,,he
even said that even if i did find the policy number it wouldnt
make any difference?? even though the letter was asking for
this information,,what really gets me is the two small barclay loans
i had also in 1992,i have all the paper work and ppi break downs
he says that dosnt matter, and its all to do with them being a
member of the GISC?? went into my branch and they have never
heard of it lol, they are looking to see if they can get me all the info
they can regarding my woolwich loan, just for my own records,,i now
have forms to fill out for the Ombudsman, but at least i can do it once
and let them get on with it.
Just had another look at the letter and it says before barclays became
a member of GISC on NOV 20TH 2001??
So they were a member from 2001,,so why cant they look at
my claim from 2001?just because the policy started in 1996
it all seems to be very convenient for them

    Many thanks Amersall, mark..

Yes I got a letter but no reason for rejecting, just said they looked at all info given and they dont feel it was mis-sold, didnt explain why they felt is wasn't mis-sold, So I sent a letter to say I was not accepting there rejection but I never got a reply so I sent it to FOS bank in October 2011.

    Thank you

What reasons did you use for mis sell, you need to contact FOS if you have any other reasons other than the ones you gave in your claim.
I hope you told them what Lloyds said when you telephoned.

If we knew the reasons they did not uphold, there may be other we can give to help you further this claim.

People are posting on here about the fact that Barclays are using the GISC as an excuse (they are right as to the date) and this is a fob off,you still have the right to complain to FOS if your claim is not upheld.Barclays are making it sound like you have no claim as your loan was pre this date.
People have won with claims from the 90s,looks to me like they are trying to fob a lot of people off.

If you get the account number for this loan from branch,(you only need the account number and reasons for mis sell)send the details to Barclays and dispute the rejection on the grounds of GISC that they stated, and put a complaint into FOS regarding this.

Yeah, that's what I thought. I have one more idea which I will check out tomorrow - it's just possible that I can get bank statements going back further which will show my payments to the CC. I know this wouldn't be ideal as it won't show the split between CC payment and PPI, and there'll be no evidence of the balance, but maybe it'll go somewhere :)
If that doesn't pan out then I'll just accept the offer. Frustrating 'cos MBNA went back the full 10 years that I'd had the cards, no problem.
    Thanks Amersall.

The bank statements wont help i am afraid, this ,as you say, does not show the ppi payment and they would need this as proof.

You could write back to the bank and tell them you had this card x years and could they look at this again to come to some "agreement" over the previous time, this may not work, but you wont know until you try.
  • Amersall,,
will do i have the account number, and iam filling out the FOS forms now
you have been a great help,,many thanks and i will keep you guys updated
I have great success witn MBNA,and iam waiting for my second settlement
figure on a £7500 loan with them over 5 years any day they said the 14 jan
and i have a RBS credit card with PPI on it, these credit card seem for me
to be alot easier to deal with than loans ,,Barclays have given me 5 months
of hell,,i need help from THE FOS now,i felt like every time i jumped through
a hoop, there was another one to jump through lol...
many thanks keep up the great work
    regards mark..

Good luck with MBNA ;), no I don't have a claim with Barclaycard mine is with Central Trust who were the broker for a Firstplus loan we had. We never got a no from Central Trust we got a low offer that is why we had to take it to the FOS. When did you pass your case on to the FOS?

Middle of last year. just had 1 letter to say that they (FOS) had approached MBNA and they still werent going to agree to miss selling and so it will be passed to an adjudicator and they will contact me when they need more info.

I just wondered if anyone else had gone through this? How do the FOS handle things? Is it still worth fighting or does the FOS just look to palm you off after this?

    Thanks amersall,
I did not know ppi was included at the time of taking the loan out and nothing was discussed about it at the time just how much it would cost to repay monthly. I have emailed the FOS to let them know about the phone call.

    Thanks again
  • Just a quick one, my wife claimed against Abbey National around the 4th or 6th Jan 2012 and within TEN days the money is in her account (yes you read it correct TEN days) whats that all about but hey she got paid back and thats what counts  :T
  • Just received a cheque from MBNA for £5712 - no explanation of how they arrived at the figures, but delighted...Complaint rejected by MBNA in November, complained to FOS, MBNA then said they would uphold my complaint on 24th December, cheque arrived today...:)
    MBNA Credit Card PPI 1 Upheld - £1314 :)

    MBNA Credit Card PPI 2 Rejected :( - Complained to FOS....MBNA Upholding....Awaiting Figures :)....Cheque Received £5712 :)

    Hi amersall

I have been following bluevans posts regarding Barclays and I too have had a similar experience with them in respect of them playing the GISC card as the reason for not upholding my complaint. I have since sent paperwork etc to FOS for PPI claims on a Barclaycard (approx 1998 - to the present day), Mercantile loans (an off-shoot of Barcalys plc 1995 - 2003). I know this could be a long haul which is frustrating as Barclays have been the most evasive and difficult to deal with eg, claiming non receipt of paperwork, claiming there was no PPI on the card when there was, no records of the Mecantile loans when I supplied copies of all the relevant agreements when I made my complaint.

I was wondering, is it worth writing to Barclays again saying that the GISC thing is not a plausible excuse and advising that the matter has been escalted to FOS. I am sure that I have read on this forum that some posters have done this and the bank they originally complained to have reviewed the complaint and upheld it.

Off topic, its been a while since I have posted but I am glad to see that you are still dispensing good advice!

    Kind regards
