Hello all
I posted a few months back about my MBNA claims, which were ultimately successful as I reported at the time. Since then I've had a claim upheld with HSBC as well, but I haven't yet accepted it as they are invoking the 6 year rule (my PPI with them went back for many years before that).
I've spoken to them since the offer, in order to ask them if there was any way they could access data from earlier years - they state that it's purged off of the system.
So I asked if any archives were maintained and they simply restated the 'purged off the system' excuse.
I also asked if the premium data was maintained anywhere else other than on the CC statements (I thought it might be retained on a separate system with the insurance details). No real answer given to that.
I was wondering if anyone here had any experience with HSBC in this area. Would it be worth my while making a SAR under the Data Protection Act ?
Because of the timescales involved if I go the the FOS route (spoke to them and they said it would take up to 12 months if I referred it to them) I'm basically thinking that I'll just accept what's on offer (which is a fair offer for the period it covers), but If anyone has any opinions on this then they'll be gratefully received.

The MBNA claims were upheld because I had several discussions with them when the insurance was first taken out where I repeatedly asked them if they were sure I was covered. I was asking them this because of my employment status, which meant that I was getting my income from company dividends rather than as a salary. They always answered that I was covered - obvious now that was not the case, hence the claims being upheld.
The HSBC one is a bit different because it is truly ancient - originally set up with the card in 1988. I'm not sure why they approved it but they were also aware of my employment status (which dated from 1998) as they were my personal and company bankers.
Those are the best answers I can give I'm afraid - I didn't give much more info than that on the claim forms.0 -

I made a claim to Barclaycard last May for ppi that was put on my barclaycard in 1992 and is still running!!! and they wrote to me advising I would hear in 8 weks - never had to contact them! then they said 12 weeks! had to contact them again! They said it would be 16 weeks from the start by September still heard nothing so I sent a complaint to the FOS! Still heard nothing but FOS were writing to them to request paperwork! Still heard nothing so I rang Barclaycard in October and they advised they were not upholding my complaint! They said they'd wrote just after the 16 week deadline but the letter came and was dated 27.0cotber!!! So all copies of their paperwork has been sent to the FOS who have advised that it's with a caseworker waiting to be assigned to an adjudicator and this can take 3-4 months from time of application to them which was early october so by February hopefully they will look at the case. I thought you had to have the ppi running to make a claim, however FOS advised that I could cancel, so I wrote to Barclaycard advising them to cancel and guess what? they still haven't cancelled so I rang FOS last week and wrote a stinking letter to Barclaycard advising immediate cancellation and have sent copies of the letter to the FOS to go with my case! By the sounds of it Barclaycard seem to be the slowest as I haven't heard of many successes! I am trying to be patient but the FOS advised last year that it may take a year from when they took the case!! Last september I am positive the wait will be worth it!!!!;)
This is a very interesting read , thankyou for posting , I do hope you have success , I have sent my claim off to the FOS at the weekend , seems Barclaycard are coming up with every reason not to pay claims , I will now sit tight and wait , I will post any update's when I have any news , sure it will be a long wait but fingers crossed for all who have case's with the FOS .0 -

Good luck to you both with your claims against Barclaycard,, just to give you a rough idea about wait times with the FOS I took my Cental Trust case to them in July 2011 and I am still waiting to be passed to an adjudicator. So be prepared for the long haul.

I spoke to Lloyds at the weekend about a claim I sent to FOS as they rejected back in Sept 2011. I wanted to find out two things, one if they sent the paperwork to FOS and two the reason behind rejecting it as they didnt give any real reason for doing this in the letter. When I spoke to a girl there I she said she doesnt know for what reason they have rejected my claim only that some of the loans are ones where when setting up the loan you couldnt cancel the insurance, which i dont even recall anyone explaining the insurance to me anyway. but you get a letter in the post stating you have 14 days to cancel????

Following a comment from a friend I visited your site and decided to try to claim PPI on an old Capitol One account I knew i had paid ppi on in the past - I successfully claimed a few hundred pounds back!! That is not the end of the story on reading more advice from you I realised that I had been paying TMPP (total Mortgage Protection) on my current mortgage for the past 10 years and realised that I had, had little and near zero chance of ever being able to claim on it unless I died! - I was self employed with 3 different jobs! To claim I would firstly have to wait 6 moths and then could only claim if I had lost all three contracts. Losing any one would have made paying my mortgage impossible so could not see the point in paying what I had or continuing to do so - so following your advice I put in a claim as I felt that it had been miss sold to me – one letter and 6 months later and with no hassle Halifax have re paid me all my payments with 8% interest = £8,500!!!! Now that is what I call success – I would never have dreamed of even writing that first letter – thank you

Came back from the school run this morning to a letter from HSBC offering £17,238 OMG
I have to say, I nearly collapsed, I expected about £ 2000-3000. ..

You are waiting an Adjudicator, is this because Barclaycard have refused miss selling.
I have a Complaint against MBNA the only one I haven't won YET! but FOS has contacted them and they still say it wasn't miss sold and so the FOS are passing it to an adjudicator and I was wondering if this may now be a lost cause. Fingers crossed it will get sorted soon.0 -
Ammersall, thanks so much for your reply,i was self-employed,and i had savings to cover the loan,so i did not need PPI,in the first place,i have all my statements showing the loans been taken out
of my account,i know what i borrowed,and i topped up the loan
over a period of 10yrs,i calcualte i borrowed around 9k,and payed
back nearly 19k,iam in shock,i have also just found out on my RBS
card i was paying PPI aswell,phew,this is hard work lol,, I have already got back to them,,its like batting the ball back at them,i have to say Barclays are testing my patience,so i have started to work out the ppi myself,i have kept all credit copys and policy numbers from two more loans in 1992,but this last loan was with
the woolwich and it was all done over the phone,and i reckon,they sent me a document to sign to return,but not one with a policy number on it?? But i can prove what i was paying and for how long
and its way more than any interest rate,sorry ott i have been on this all day so if there are any spelling mistakes ,,forgive me

Tell them to look at this claim again,as you were mis sold this ppi because...use the reasons you gave above and look here for anymore...

Tell them that you do not accept that they cannot deal with this insurance because it was pre 2001 and they were not members of GISC,if they dont look at this claim again,you will send all correspondence from them for your claim to the FOS and that way you will get a fair hearing.
Also,you only need the account number to make a complaint,not the ppi policy doc.0
