My reason for claiming, was that I wanted to see if I would getting anywhere !!
The justification I gave on the FOS form was that I could not recall being advised of any conditions or costs associated with this insurance, was self-employed and had a pre-existing medical condition which would probably have invalidated any claim I might have made ! All of these are true, saying that, I really don't think anyone at MBNA could have checked !!

I never thought I would be posting here. I followed Martin's advice and with encouragement from fellow posters (thank you HaveFaith!) I kept plugging away.
I had one statement from 2005 so sent off the initial letter asking for paperwork with £10 cheque. Received a statement back with PPI listed (approx £1000) so sent off another letter saying that I never signed up for PPI, which I didn't. They then mysteriously 'lost' my original application form so I phoned them to complain. To cut a long story short I ended up sending a letter threatening to take them to the financial ombudsman and a few weeks later received a letter saying that my complaint was upheld and I would receive a cheque for £3,500!!!!!
Cheque arrived within days which I wasn't expecting at all.
Thank you MBNA and thanks to all the posters who encouraged me to keep going.

All i did was rang mbna complaints line, lodged a complaint over the phone, 3 weeks later I got a cheque coming for just short of 6k... Its the easiest 6k I have got from a bank!!!!:beer:0 -

was dealt with very quickly and claimed a sum of around £2800,and iam now waiting for a
loan i had with them for £7500 over a 5 year period,was told i would get a figure by the 14th
of jan,,My problem is i had a loan with the woolwich/barclays way back in 1996 which i kept topping up right up until 2006,
so i was still paying it off in 2006,i have all my statements to prove this,and have given them
all these details,but they have upheld this again saying that the length of time since i commenced
my insurance cover was before barclays became a member of GISC on 20nov 2001,they have been
unable to retrieve any details of PPI charges to my account
I have rung the Ombudsman and they say unless they say something about 6 weeks to reply the case
is still open , even though the bank is saying its upheld?.
I thought if i had been paying this loan off in 2006,there would be a paper trail for them to follow
i have had two smaller loans with credit agrements which i sent a copy to them,which states,the
PPi and still they cant acknowledge it,has any one else had any problems like this,i started these
complaints in August 2011..

Hi there,with ref to the Barclays loan,think they are telling porkies about not being members of GISC,give me time and i will get the info you need about this,as for them seeing ppi and not acknowledging, this is poppycock.
Did you send copies of the statements (i presume you did) and what were the reasons for mis sell you gave?.
I and others on here have had ppi upheld from the 90s,so dont give up yet.
They did not "upheld" they rejected,and it is 6 months to take it to FOS,they have not said this,so you need to get back to Barclays.
Will post when i find out about the GISC thing.0 -

Ammersall, thanks so much for your reply,i was self-employed,and i had savings to cover the loan,so i did not need PPI,in the first place,i have all my statements showing the loans been taken out
of my account,i know what i borrowed,and i topped up the loan
over a period of 10yrs,i calcualte i borrowed around 9k,and payed
back nearly 19k,iam in shock,i have also just found out on my RBS
card i was paying PPI aswell,phew,this is hard work lol,, I have already got back to them,,its like batting the ball back at them,i have to say Barclays are testing my patience,so i have started to work out the ppi myself,i have kept all credit copys and policy numbers from two more loans in 1992,but this last loan was with
the woolwich and it was all done over the phone,and i reckon,they sent me a document to sign to return,but not one with a policy number on it?? But i can prove what i was paying and for how long
and its way more than any interest rate,sorry ott i have been on this all day so if there are any spelling mistakes ,,forgive me

I made a claim to Barclaycard last May for ppi that was put on my barclaycard in 1992 and is still running!!! and they wrote to me advising I would hear in 8 weks - never had to contact them! then they said 12 weeks! had to contact them again! They said it would be 16 weeks from the start by September still heard nothing so I sent a complaint to the FOS! Still heard nothing but FOS were writing to them to request paperwork! Still heard nothing so I rang Barclaycard in October and they advised they were not upholding my complaint! They said they'd wrote just after the 16 week deadline but the letter came and was dated 27.0cotber!!! So all copies of their paperwork has been sent to the FOS who have advised that it's with a caseworker waiting to be assigned to an adjudicator and this can take 3-4 months from time of application to them which was early october so by February hopefully they will look at the case. I thought you had to have the ppi running to make a claim, however FOS advised that I could cancel, so I wrote to Barclaycard advising them to cancel and guess what? they still haven't cancelled so I rang FOS last week and wrote a stinking letter to Barclaycard advising immediate cancellation and have sent copies of the letter to the FOS to go with my case! By the sounds of it Barclaycard seem to be the slowest as I haven't heard of many successes! I am trying to be patient but the FOS advised last year that it may take a year from when they took the case!! Have sent a request for my original application and fully account breakdown , have received a letter today referring me to the consumer Credit Act Section 78 (3a) , they advise that they are not obliged to provide me with the documents / information including my statements as my account was closed in October last year .
Not happy to say the least , have been back onto Barclaycard and they have now agreed to send me a copy of my application but are still declining to send statements despite sending £10.00 cheque which they say has not been banked and has been destroyed .
I am going to try the FSO but do not hold out much hope , have paid hundreds of pounds for cover and have been a stay at home mum since 2008 , so useless if I had tried to claim .
Has anyone had any success with the FSO and Barclaycard as I have come across so many hurdles .0 -
Hello all
I posted a few months back about my MBNA claims, which were ultimately successful as I reported at the time. Since then I've had a claim upheld with HSBC as well, but I haven't yet accepted it as they are invoking the 6 year rule (my PPI with them went back for many years before that).
I've spoken to them since the offer, in order to ask them if there was any way they could access data from earlier years - they state that it's purged off of the system.
So I asked if any archives were maintained and they simply restated the 'purged off the system' excuse.
I also asked if the premium data was maintained anywhere else other than on the CC statements (I thought it might be retained on a separate system with the insurance details). No real answer given to that.
I was wondering if anyone here had any experience with HSBC in this area. Would it be worth my while making a SAR under the Data Protection Act ?
Because of the timescales involved if I go the the FOS route (spoke to them and they said it would take up to 12 months if I referred it to them) I'm basically thinking that I'll just accept what's on offer (which is a fair offer for the period it covers), but If anyone has any opinions on this then they'll be gratefully received.
