    this is just what Barclays are hoping you will think! They are coming up with some disingeneous reasons for rejecting complaints at the moment. :angry:. Plenty of other posters finding this espescially if your complaint goes back to the 1990s. Read this thread
    ppi refused by barclays due to insurance standards council code of practice

    I found this on Barclays website under FAQ

    "With payment protection, how do I make a claim?

    You can get your local branch to arrange for a claim form to be sent to you or you can download the claim forms from the Guides & forms page. You will need to complete the relevant form and send it to the address shown on it. Please ensure you select the relevant form.

    In addition, for Payment Protection Insurance claims for overdrafts, Barclaycard and mortgages, you can call Barclays Insurance Dublin on 0500 500 700, Monday to Friday 9am-5.30pm. Textphone: 0870 400 4855. Disability helpline: 0870 400 4854."

    Also In their Overdraft Payment Protection Policy Document (also on their website but hidden) it states;

    " 7. Data protection
    You have a right to see personal information which is held by Barclays Insurance(Dublin) Limited or Barclays Assurance (Dublin) Limited. There is a charge if you want to do this. For more details write to
    the Data Protection Co-ordinator, PO Box 586, Shannon, Co. Clare, Ireland.
    Alternatively you may contact the underwriters directly by calling 0500 500 700*, by faxing 0870 400 4865."


    I have found the Dublin office to be helpful. Worth a try phoning them? They told me the exact date my ppi started in 1994

    Good luck and don't let them put you off claiming.

    Husband has just had £3, 327.00 back from Lloyds for PPI on a car loan.
    Started claim in June 2011, upheld Oct 2011 just found out it was paid Dec 28th 2011. He got his back as he is diabetic and they never asked about his health at time. All claims would have been invalid as all health problems would be attributed to pre-existing condition.:T
    Have just cancelled PPI on my MBNA credit card can I still try to claim? It was originally Alliance and Leicester and I feel sure I was pushed into having PPI and did not fully understand at time. Have already had a refund from Alliance and Leicester for a loan which they wrote to me about when this scandal first reared it's ugly head. Should I have asked for a refund when I cancelled it and will this affect any claim I make now. Advice would be much appreciated.

  • My wife took out a series of loans from Barclays some time ago, re-financing each one with another. She wrote to them and to our surprise she received a letter admitting that she had been mis-sold PPI and was entitled to an 'estimated' figure of c£4500 in compensation. Despite this letter having been received in August 2011 she is still waiting for the money. When she phones them she is being fobbed off with excuses about her claim having to be reviewed, or 'it has gone back into the system to be re-assessed'. She has complained to the Ombudsman and told Barclays that too but I am beginning to wonder if the money will ever be received.

    You can still put a claim in for the card,you need to send mis sell letters to both banks,you want ppi from the time you had the card with A&L and from MBNA when they took the card over to the day you cancelled.
    If you did not have ppi with MBNA then just go to A&L.

    If you're still on here, did you have to go via the FOS, FLA, or original underwriter to get your money back?

    My parents both had claims with Debenhams store cards taken out in the mid to late 90's.. I've not seen many successes on here, although I think a lot off ppl have given up to soon..
    My mum was a housewife! and my dad self-employed and both had PPI on these cards that were closed a few years ago. My dads was rejected and is with FOS and my mums had an acknowledgement stating contact in 4 weeks..

    No I cleared off my card in 2008 so still had the agreement number on my credit file. I started with GE then passed to Santander then the FLA etc etc etc. All in all from start to finish 15 weeks.

    Having trawled through a load of these pages - I've only seen one or two success stories with Capital One.

    The FSA website shows their General Insurance & Pure Protection section receiving 21681 new complaints January 11 - June 2011 and their actual UPHELD figure is 28% which compared to most others is a small percentage, around half of what other major companies seem to be accepting.

    It actually astounds me how low their complaints stats are - I think a lot of people must put off by the impregnable call centre who refuse to log complaints or pass you through to the UK, that and you have to actually write to them to log your complaint.

    Anyway, after waiting a little over 6 weeks for a reply, I recieved a letter refuting my complaint a few days ago. Clearly it was a template letter, half of which was irrelevant, so it looks like they are trying to put off as many people as they can and hope that not too many people go to FOS.

    They also said they had no record of the call on which I took the PPI on as if that solved the issue. Wrong!

    Luckily I'm too stubborn to give up and worked as a Complaints Manager for a large financial company for several years so know it's best to keep at it, annoy them and DO NOT give up!!!

    Capital One for some reason do seem to do well when challenged on PPI.

    I recently had 2 claims, one for a loan and one for a cc rejected by the adjudicator...this is something I have escalated to the ombudsman.

    In my case, my claim for mis sold PPI was rejected out of hand....I went to the FOS...a lengthy chat with the adjudicator did not find in my favour..however I discovered that Cap One don't send in phone transcripts to the fos, but a copy of a sales script that their staff are supposed to adhere to...so, to my way of thinking..this is collaborative but not conclusive, no transcript ...no proof...so I have taken this further to the ombudsman.

    Many cases for Cap One are not successful, but they are rogues, and as such, deserve to be facing up to their responsibilities just like the high street banks....

    I completely agree and I am not surprised they are up to this sort of thing! They wrote in my response that I had actually 'requested' PPI...hmm I think not.

    I've questioned that if they have no record of the call how they can then confidently base their reply on an assumption - which they obviously can't do. They do seem to conveniently forget that by introducing this product into every sales call or adding it to every application form that they are endorsing it.

    I suspect they are trying to delay paying for as long as possible in the hope that some relief or get-out clause comes to light. However, I suspect they can only refute such a huge percentage of reportable complaints for so long before the FSA get involved - afterall, if there are no problems then why are so many people complaining? Fingers crossed they don't stay off their radar for too much longer.

    I'll also be taking my case to the FOS, it can be a long process but generally (though perhaps not always) I found them quite fair when I had to deal with them previously whether they ruled in favour of the company or the policyholder.

    Good luck Citibird, perhaps the threat of so many £500 FOS fees might give them the swift kick they need. :) x

    I submitted my complaint on 27/09/11 following receipt of SAR info as I did not realise I had been paying for PPI. My complaint was rejected on 26/10/11 as I apparently "purchased PPI when I applied for the credit card". I am disputing this and wrote again to Capital One on 5/11/11 asking them to reconsider the decision for the following reasons:

    A copy of the application form was not provided as proof with my SAR info and I asked for a copy

    According to the SAR info received, PPI started on 26/01/03 and this is inconsistent with reason for refusal as the start date of the credit card was 5 months earlier!

    No response was received following my letter so I have now referred it to the FOS althouh given published figures, I am not holding out much hope! I will keep you posted...
