PPI Reclaiming successes and failures

  • Good Evening,

I have prepared an email to First Response Finance which I have now sent indicating that if PPI was added to the credit agreement witohut my knowledge then the legality of the credit agreement is nullified as its fraudulent.

As a result I have now demanded back all interest and other charges paid on the loan leaving the actual loan amount which of course I have already paid back.

My thinking is that you can't enforce a legal document that has fraudulent content included - that makes it illegal.

I have indicated that is they do not provide a resolution within 14 Days then I will seek criminal proceedings separate to that of the PPI complaint under the fraud act 2006. I'll see if this speeds up my PPI complaint and see what happens regarding the interest and charges paid on the loan.

I think this is an angle worth exploring its no different to a parking ticket where the lines are broken.

    I'll see what happens.
  • Received my upheld/offer letter today from lloyds tsb. Old Loan from 2001, which I still had the Agreement after moving home twice (sad). Offer £10,890 done with the advice of prowling round this site, filling in the simple form and waiting 11 weeks. Also received £5,700 in September reclaiming MPI, again from Lloyds TSB. DO NOT USE A CLAIMS COMPANY it cost me a couple of pounds for recorded delivery and I get to keep it all (minus tax on the 8%) Stop thinking about it and DO IT.
  • Hi -- I wrote a polite letter to my branch asking to reclaim back my PPI on loans I had with the bank.
Great success!! - after 3 months wait (but worth it) i got all my monies back on my previous loans going 8 years !! total £7500. I did not bother with 3rd party concerns, so its worth contacting the bank direct.
  • In addition to my PPI refund of £5509, LloydsTSB have refunded me £1568 after settling my loan early.

2011 has seen LloydsTSB pay me £7077 minus the £2100 i owed them thats £4977 better off. Wedding September 2012. What a blessing.
  • Well Done on winning the fight let the battle continue. Hopefully we can get all our money back and reduce those banker's bonuses.
  • I'm confussed as to why we may be going into a ressision after christmas. Surely with so many getting these refunds that more and more will be spending money they otherwise would'nt have.

Maybe i have missed the point or clearly don't understand any of it like i thought i did.

Would anyone like to educate me? Please!

I just wanted to say a big thank you to everyone me help and advice on this.

We recieved a letter last week to say thatour claim was being upheld and that we would be getting ~£11K returned to us.
It was upheld as my now husband was a full time PHD student at the time!

This is more than my rough calculations had come up with by some way so as you can image my jaw fit the floor when I read the details. Merry Christmas one and all! Ours will be going into savings and also help make overpayments on our mortgage!

Thanks again everyone, now I just have to wait to recieve the payment... any ideas on times for this to turn up?

  • Just wanted to say thanks for the assistance received from this site, have received offer letter today from Lloyds TSB Old Loans from 2003 and 2004 offer of £11k.

However I had a new loan 2007 which I defaulted on due to financial difficulty and have not been in a position to pay. Debt was then sold off to external financial company, which I am in negotiations with and have a payment plan with

My query is if debt has been passed/sold on will Lloyds refund come to me or to the finance company to go towards debt?

Any ideas on when refund is likely to come through as I have seen various timescales from 14 days to 90!

    Any help would be appreciated
  • Hi. LTSB have ruined my financial life through getting me into trouble with bank charges that were not warrented and spiralled ruining my credit, promises of loans and with telling me I would be more likely to be accepted for my loan if I had PPI to the extent that I have now had no choice but to go to the Citizens Advice for help.

I went through the bank to put a claim in and I have since been offered an amount on the 1st Dec, fantastic. In my current financial situation, which no thanks to them is bleak, I could really do with the cash and am checking my account everyday to see if the money has been paid back. It would make my Christmas actually! I am now very disheartened to see how long people are having to wait and how frustrated they are.

I am sick of feeling like the little guy who just gets trampled on. Life is a struggle enough! I should be able to charge the banks everyday a fee for non payment, that would be good. Who is going to put the banks in their place and make them pay out? Look at all the unhappy, stressed people.....
  • Hi Folks,
