Hello money savers!
I have had an ongoing refund claim with Tesco Bank for a loan which I have repaid and now the account is paid off and closed. My initial letter of complaint and statement of intent in regards to refund was sent in the middle of August this year.
One of the main reasons I was asking for is because I have a rare medical condition and think I have fallen under the umbrella of not being able to claim should I have gone sick. Also I dont believe Tesco enquiring if I had any pre-existing medical conditions during my loan application.
After a couple of letters later saying they were waiting on information and a phone call from myself, I had their response today through the post today some 16 weeks later (yes I've been patient lol)
As expected they refuse to pay up. A rather wordy letter, but I was a bit concerned at the end of the letter when it came to my medical condition. Paragraph reads...
"As your Tesco loan application was completed through a non-advised sales process, it was necessary for you to review any existing cover or employer benefits you may have had in place and any alternative policies on the market. There was also no requirement to discuss any pre-existing medical conditions you may have to establish if the policy was suitable for you."
This to me doesn't sound right and they have just backed up what I thought, they never asked me about my pre-existing medical condition. Should I go to the ombudsman, has any one else had this experience what do you guys think?0 -

Have just posted the following story in the Lloyds TSB PPI thread. I guess it counts as a success (of sorts) but I'll let you all know how it pans out.
9th August: Contacted FOS to enquire about PPI claims, etc. They filed the initial complaint to Lloyds TSB.
11th August: Letter from Lloyds acknowledging complaint and requesting that questionnaire be filled out and returned.
18th August: Questionnaires sent via Recorded Delivery
22nd August: Delivery signed for by Lloyds TSB
1st November: Call to enquire about status of complaint (16-week deadline approaching). Parents told that the complaint is still under investigation.
15th November: Call to enquire about status of complaint. Again told that complaint is still under investigation. Parents are asked for more information. Becomes clear that Lloyds do not have the questionnaires that were returned and signed for in August. Parents were not told this 2 weeks earlier. Agree to email them to Lloyds and are told that there will be an answer by 1st December. Email the questionnaires (and receipt for Recorded Delivery) to Lloyds, copying in Andrea Barry, Ian Hallett and the individual at the FOS who originally spoke to my parents. Ask for a response to acknowledge the email.
18th November: Call to enquire about the email. Had expected a response but received nothing. Told that the forms were received. No apology for not even replying with a quick thanks. Again guaranteed that an answer will be provided by 1st December.
24th November (Today): Call to enquire about status of complaint (the deadline is a week today). Told that a letter was scanned into the system yesterday (23rd November). Individual has a look through the system and confirms that PPI on all three loans are being repaid. Total amount to be repaid is over £15000.
So my parents now await a) the letter confirming the settlement; b) the calculations letter; and c) the money transferred to their account. I'll keep you all posted on this (relative) success and let you know when letters and payments are received. Given some of the stories on here, it could be a while!
Cheques received on Saturday. Banked this morning! Happy Days!!! Now on to MBNA, M&S and Black Horse...0 -
Anybody had any problems recieving cheques from barclays our 40 working days is almost up and no light at the end of the tunnel already emailed bob diamond feel like giving up now sick to the back teeth of ringing to be told a different story all the time:mad::mad::mad::mad:0

Anyone who has reclaimed from Capital one for credit cards, shed any light on how they deal with PPI reclaims. Are they putting up a fight? I sent £1 off for my credit agreement. They sent me a reconstituted agreement, saying they were not legally obliged to send original. However they did send my a photocopy of my signature ( so they could have sent agreement if they wanted to.....).
I submitted my questionnarie to capital one, on the basis they haven't proved I asked for PPI. They said they will contact me within 8 weeks.
Has anyone else had luck with Capital one.....?0 -
Just to say that for those thinking about claiming against MBNA, then do. Thank you to all the people who help others on this forum, it really is deeply appreciated!
Thanks to the advice I claimed against MBNA with standard info and on Saturday I found out that £3300 is winging it's way to me in less than 28 days! Fantastic!

Look here for reasons for mis sell http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#step2 and if any/all apply to you then send this info back to them telling them you do not agree with the decision to not uphold,and please take a look at your claim again.0 -
Thanks for your reply, yes the loan was from the internet, and I do agree that I opted in for PPI, however no information was given to me informing me that I would not be able to claim should I go ill with my condition. I was sent information through the post about PPI but at no point have they asked me about any medical conditions. Surely if a company are going to sell you a product you would not be able to use then I have a case? What would have happened if I had become ill and could not work and then make a claim what leg would they have to stand on?? I still wasnt made aware about the restrictions on the product0

letter to confirm the sum arrived today (THE GLOROIUS 12TH) it was dated 1/12/2011 so where has that been i wonder.
my take on this is as follows it missed going out the 2nd so not being capable of going to the post box during the week its finally left LTSB on friday 2nd class post .
we now with some sort of hope that the money will be here sometime this year (not a prayer)we think but hey ho its the season to be jolly.
