I have the loan agreements for the two most recent (one from 2004 ish and another from 2007) the first isn't dated so I'm relying on my memory here as I don't have statements any further back than Jan 05 and I was paying it then.

The 2007 agreement has a cover letter stating that 'along with this letter you will find a further copy of our insurance leaflet with your cancellation rights enclosed'. I don't have this 'leaflet' but it's prompted me to think that I may be paying PPI without realising.

It should state on the loan agreements a ppi amount,if there is not one, then you may not have had ppi on there, give them a ring and see if they can explain this to you as you say the monthly payment over the term does not add up.
I've done calculations on the loan amounts, term and interest rate over the term and neither loan add up to the monthly payments, calculating around £15 unaccounted for each month.
Take the total monthly payment you paid over the term and times this by the term, the interest will be in this payment for the term.

My other query is that all of my loans have had a early settlement 'discount' which I'm fairly sure weren't taken into consideration when I settled them with a new loan, can I reclaim this to?

If you know they had early settlement discounts, they must have taken these off your loans when you settled.
Give them a ring and ask why the payment is £15 different each month, as you have the agreements, requesting info for these accounts is not worth the £10 they charge,as you have the "evidence" so to speak.

    Another success!!

Halifax TMPP, sent in October, decision wasn't due until early January 2012, so well chuffed it's came in now.

Offer of just over £2500, if they are as quick as the credit card we should get it within the next week, although we'll wait and see!!

Congratulations to all those winners so far and good luck to those still waiting.

Halifax secured loan and small RBS loan to go!

Just sent a stinking email to LLoyds. I've phoned every other day for the past week and I'm seriously fed up, with a capital F with this waiting game. Original forms sent in May, upheld in August and offers early Sept. They have said that they are paying an extra months interest for the timescale of payment, but I just want my money!!:mad: In the email, I put that I would be taking extra advice if my money was not in my LLoyds account by close of business today. Doubt I will get anywhere, but I hate not having any control over what is rightly mine. There, rant over. Good luck to everyone else today.

  • Can anyone help please ? My claim against Barclaycard goes back to 1997. Upto and including February 1997 I agreed and paid for Purchase Protection - no problem so far.

However, in March 1997 they automatically changed it to Payment Protection without my knowledge or consent. This continued until July 2002 and totals about £634 - I still have all the statements.

They have rejected my complaint - making one fundamental incorrect assumption which I will challenge - but they also state that I cannot progress it to the FOS because the 'sale' took place before they became signatories to the General Insurance Standards Council Code of Practice.

Are they correct in stating I cannot take it to the FOS and if so is there a way around it ? Thanks.
  • Firstly waited for the 16 weeks for a offer letter then they added a further forty days wait up to 5th November. Have called numerous times on the 0845 number which cost me to call and be on hold an average 27 mins which is very, very frustrating. I have been told they apologies for breeching the trun around time but have no further news and still don't know when I will be paid. The excuse yesterday was they are aware that they are falling behind the recommened timescale but are sorry can't do anything about it!

So from star to date I have waited approx 24 weeks nearly 6 months that's not acceptable I bet they'd soon be on my case if were waiting for me to pay them back!!!!!!!!!!!!!!!!!!!!!!!!!!!!!    :(
  • Been on to FO this morning to see if they can chase up FP on paying out my refund, they said they could but it would reset the start date and could have to wait a further 6-8 weeks, some use they are.

Then contacted FP and managed to get hold of a manager, now theres a first, who has promised, as I am an urgent case having already waited 12 weeks due to their error, will call me back this afternoon with a payment date.

Fingers crossed, wonder if this has anything to do with me e-mailing their CEO.

They are correct i am afraid, you need to find out who the insurer was, ring and ask who they were,if they cannot tell you then ring FOS and they will find this out for you, also ask them if the insurer was GISC registered,if they were then put a complaint into the insurer and if they say "no" then the FOS can help.
