    Hi,
Had a final rejection letter today from Capital One ref a cc PPI claim id sent them. I was sold the PPI over the phone not when I took the card out and I stupidly agreed to a persuasive salesman. I sent in my complaint form detailing the fact that I was a Civil Servant with comprehensive sick/redundancy cover already and also that I had a pre existing medical condition I was never asked about. Their reply was that Id agreed to accept a limited Terms and Conditions explanation over the phone and that most people were entitled to statutory sick pay from their employer, and their cover was to make up any shortfall or help with financial hardship. My sick pay includes full pay for up to 12 months so therefore there wouldnt be any shortfall.
As I said it was a final rejection letter, so my question is should I write to them again restating my case or go straight to the FOS? (or not at all)!
    Any advice greatly appreciated.

    Hi
Do write to them again and tell them you want this reviewed and also ask them to provide you with a copy of the evidence of the telephone call, afterall they must have this if they said you agreed over the phone.

Give them any further info/details that applies to you and add that you have a genuine complaint to make a reclaim.

Sometimes they will even change a final decision, so do bring up the issue of the telephone call, good luck.;)

What were you reclaiming:(eg. loan, credit card, store card):Loan
Who was the provider:(e.g. Capital One, NatWest)Firstplus
How much did you get back: £33845.54:beer:
Did you get it back after a letter or did you go to the Financial Ombudsman:: One phone call only
And then write your brief reclaim tale
Been lurking for several months one phone call made no expectations but after reading all the posts on this site fairly confident I had a case ie Must take PPI but no problem just regard as a saving scheme. money back after 5 years no mention that it ends after 5 years but continues to be paid as part of loan, no discussion about financial suitability ie full sick pay for both me and wife and the fact that I have never taken PPI out (too mean, too poor, too Scottish) received uphold letter today 11 weeks (one week before deadline) payout 6 to 8 weeks from receipt of acceptance:rotfl: good luck to all other Firstplus claimants just do it its your money:)

    WOW!:eek::j:j Well done to you!:T & Congratulations!:beer:

    Hi there,

Same here!! Capital One seem to do well in defending against claims!
I had a rejection from Cap One, and then the adjudicator for the ombudsman also found in their favour..however, am escalating it up tp the Ombudsman now.

The salesman was very persuasive, and also, they have been known to be very economical with the truth, so am determined to have my fight!

    Good luck, and keep fighting!

    Cheers

    Hi

Is this a common excuse for turning down complaints? My two complaints (Northern Rock loan and Lloyds CC) are heavily based around the fact that I qualified for sick pay and redundancy payments so may not have been able to claim. has anyone else had refunds from Lloyds or NR purely for these reasons.

    Thanks

    J
  • Good day to you all, can someone help I had a letter from HSBC yesterday they are going to re-pay my mis-sold PPI for a Flexi Loan I had in back in 2000 to 2001. Problem it says on the letter that they do not hold statements going that far, I never had any statements, does this mean I will not get a payout if I cannot provide a statement for them. I they know when it was started and finished so surley they know how much is was for (i cannot remember how much it was for). So my letter came with no figures :( can anyone help or advise please

Second question I had another letter from Sainsbury Bank (Bank of Scotland) come on the begining of Sept for PPI against my credit card I had with them sine 2001 to present date, I cancelled the PPI back in 2006. They accepted my claim for mis-selling i had to sign a form send it back to them they had this around 9th Sept. 2011. I still not ad any figures yet I have called them and they do not know when they will be sending payment to me. Can anyone shed any light one how credit card PPI refunds work. I have £5100 limit which it has been maxed out almost all the time.

Finally any congrats to all winners :) and thanks to MAtin and his team for making us all aware of this situation.
