PPI Reclaiming successes and failures

SUCCESS
Bank of Scotland Credit Card, 12 week time was up on Monday of this week, received letter today saying found in favour and redress of around £1600 which is a good result, didn't have most statements due to shredding, but happy with whats been offered. Went online to card statement and have had the money credited to the account, clearing what balance we had, should find out on Monday once the monthly payment has been cleared and the ppi funds have cleared how much will be given to us but should be most of it, woohoo.
Letter and credit to the card account were both dated 1st November.

Just thought I'd let all you people waiting on RBS to payout well got home tonight to my CHEQUE:j for £1,887 finally !!! Looks like they are getting there with payments. Slightly miffed though cos cheque is handwritten, dated 12 October, which is exactly one week before we got all the letters saying "sorry you might have to wait another 4 weeks" and covering letter with cheque dated 1st November, so why has it taken them from 12 October to now to post it??? Anyway just glad its here, now my life can get back to normal.
For your info, acceptance letter sent and received by RBS on 13 September, was for a Direct Line loan.

Would really appreciated someones advise on how to proceed.
I have received a rejection letter from Santander who are now responsible for the Time Retail Finance Card I had which is now paid off. - No refund offered. Last PPi payment taken Dec 2009 ( Don't know why)
Account paid off Jan 11.
Their response briefly:
Acknowledged PPI was applied to account in 1991, but due to time lapsed unable to retrieve legible copy of agreement.
They say that once a customer has decided to take a produt then thet policy document and summary mailed to me with 30 day no-quibble right to cancel. - NO POLICY DOCS EVER RECEIVED., NO DISCUSSION EVER TOOK PLACE RE PPI.
Advised PPI clearly shown on account statements - True but was not asked if I wanted or needed it, nor was it explained what is was. Infact was not told it would be applied to account.
They also say that they have no way of knowing what took place when the account was opened, but I that I would have had 30 days to ask for PPI to be removed. -How would I when I didn't know it was being applied.
Lastly, they say that as PPI was applied in 1991 the FOS has no jurisdiction on this matter, and if I am dissatisfied with response to refer to Finace and Leasing Association.
Any help on how to proceed would be greatly appreciated.

Sorry to hear this, but its not the end yet.
Although they were not regulated by the FSA at the time you taken out the policy, the FOS as you know are not able to investigate complaints because of this, but they may suggest the underwriter/insurer avenue of the policy who would have possibly been regulated.
However, I would rule out the FLA first, so you can let the FOS know you have tried, and see what they suggest on the next direction.
Going by many posts on here I don't think the FLA have been that helpful but you never know.
The FOS will as stated possibly suggest the underwriter and if you pursue these, and it fails again the FOS will investigate what liabilities these had and involvement with the insurance when it was sold to you.
The lender/broker should provide you with details of the insurer/underwriter on request.

Just wanted to post my thanks to this site and the people on it. I sent off a PPI complaint to halifax Sept, came home today to a letter saying the uphold the complaint and £619.25 is on its way to me :j:j:j:j. I'm so chuffed, I nearly didnt send it off

Halifax tmpp claim upheld, only had the cover for a few years in 2003/2004 but will be receiving 1200 ish back

Thrilled to bits that you have finally had a refund from RBS but this is even more proof that they are not dealing with these claims in date order. Hope the rest of us will hear soon.0
