The rejection letter finally arrived this morning. It was 3 pages long. Basically it went like this:
We have reviewed the sales process and are satisfied that the sales representative would have followed the correct procedure. In addition we reviewed the telephone call recordings and are satisfied that the Account Manager explained to you the key features of the policy.
It then goes on to list timings and what was said between first plus and my husband:
At 38 minutes 42 seconds a breakdown of the costs were given. If you choose to take out the ppi the cost of this is added to you loan and the additional monthly payment is £157.72. Are you happy with the quotation and my recommendation for you to take the cover Mr XXXX? Yes I am repied Mr XXXX.
The next part of the letter goes like this: At 41 minutes 01 seconds the CAM states "the cover lasts for 5 years after that if you havent made a claim you can claim a refund equivalent to half of the insurance premiums. The CAM then asks later if there is any further information about the loan or ppi. Mr XXXX replied No I don't think so. Mr XXX does not ask for clarification on anything.
What they failed to quote is the conversation where my husband initially told them that we were both in secure jobs that gives us 6 months full pay before going onto half pay and that we never take out ppi, not even on our mortgage. They also fail to mention the bit where my husband tells them to hang on while he discussess it with me. My husband then tells me about claiming a refund after 5 years and that FP say we can use it for what we want or put it back into the loan in order to pay some of it off. At no time did my husband say to me that after the 5 years it would be worthless and we'd still be paying for it.
The final part of the letter reads: I cannot find any evidence whist reviewing the call that you were told to look on this as a savings plan. Furthermore at no point during the process did Mr XXXX or Mrs XXXX comment on the ppi as a savings plan. We will be happy to provide a copy of the call. After a full review there is no evidence the policy was mis-sold. This communication should be viewed as out final response.
At no point would I have commented on it as at no point did they speak to me regarding this.
So fellow MSE where do I go from here. Is it worth emailing the CEO still or am I chasing a lost cause?????? The anger has turned to deflation now.

Thanks to this forum I made a claim for a credit card I got as a student and took ages to repay.
I managed to get £352 from them, made my day!

Thanks for your reply, I haven't been able to respond before now sorry. The letter said they looked at the complaint as a whole to ensure that they acted fairly in relation to the sale and that they are satisfied that there were no issues with the sale. And goes on to say if we want to contact them directly we should otherwise if they don't hear back they will close the complaint and consider it resolved. Thanks again.0

Hey all
Just had my letter from Barclays, and good news my complaint has been upheld. This was from an old Woolwich loan.
But here's the downside, the lovely people at Barclays have forgotten to put a figure for the amount I should be getting back.
It's blank with the words (insert amount here)
So called Barclays and they said there was a mistake and person looking into it will call me back with actual figure. Not holding my breath.
Has anyone else had problems with Barclays?0 -

Thanks for your quick reply, this was a 5 year bank loan that finishes in May. They have considered whether we were eligible for the policy, whether it was suitable and if they provided appropiate information to us in relation to the sale. And they feel they did. I feel so inadequate in all of this, I'm really not good at fighting the establishment. As far as we can remember it was implied we would not get the loan without the PPI. My husband was in full time employment with sickness benefit and I was in part time employment and had been for 12 years so would receive full sickness benefit too. We would never have willingly paid more for the loan if we didn't need to.0

Yep - I am having mega problems with two Barclays credit cards(one was originally a Morgan Stanley card) that they appear to have got mixe dup with!! I should have had a final decision by 6/9/11 and am still waiting due to their mix up! Have rung several times, been told someone will get back to me, but never do, and have e-mailed Mr Diamond and just got a generic e-mail back stating it will be dealt with shortly!!! But still waiting for a final response!!!Claim was originally put in in early May this year!!

Just a few lines to them,to say you dont accept the decision,because....and then give your reasons.

compound interest on premiums based on interest charged on CC £ 607.41
gross interest @ FOS rate £ .19
less tax @ 20% £ .04
As your complaint has taken more than 8 weeks to resolve int @ 8% simple on the gross offer amount £1685.12 has been added btween 4.10.11 - 25.10.11 £7.76
Less tax @ 20% £1.55
Net interest £6.21
Total Offer £1691.29
