FOS have extended the goal post, as when i rang last week they told me Lloyds have 8 weeks to pay, if not then they will issue a final payment notice of 2 weeks to pay, and yes they HAVE to pay,

well it must work cause a few days after FOS issueing a final payment notice my husband had a call today saying it was passed onto a manager and his cheque should of been posted out friday and he will receive it within 5 working days, well lets see if we get it by friday.

also i did write to my mp and he did say he would help me get the payment, so i dont know if that pushed it aswell, but deep down i think the FOS did the trick
We got our upheld letter on July 19th!! and we have so far only received £1300 of the £10K they owe us, albeit we have been on the phone to the FOS today and they are now kicking some butt for us, but the timescales are such a lot of BS its unreal.... I do hope they pay up pretty soon as it will make us credit card debt free and enough in the kitty for a week in the sun for Xmas...

Hiya, just a quick update regarding my PPI refund from Halifax.

I called Halifax on the 19th October for an update on my PPI claim, I was told that they were offering me all PPI premiums plus 8% stat interest. I told the gentleman on the phone at the time that I would accept that figure. The cheque dropped through the door this afternoon! Pretty shocked that I received it so quickly!

I only wish Lloyds were as prompt!

Hopefully I'll get mine in the next couple days, spoke to Halifax today and they couldnt give me a date for payment

  • 15 weeks from claim submission have received an offer with regard to lombard direct loan - £2600. Strangely there are no figures relating to the resctructure of the remaining loan just that it will be done.

We will get paperwork off tomorrow then just the 28 working days to wait.

Thanks again for all the helpful posters on MSE.

  • EGG - After 2 letters and 2 refusals from EGG, the FOS are sorting them out.I requested a SAR on 19.09.11 from them to prove I was right about some calls made on the application. 30 days later I receive a 2 letters, one asks what info I require?, the other asking for a £1 so they could sent me a CCA request? I didn't ask for that! I enclosed £10 as well. Obvious delay tactic!! Forwarded the lot to FOS and ICO. ICO on the phone were annoyed at EGG to say the least, as were the FOS when I called them. All adds weight to my case though.
I spoke to an EGG op on the phone and he didn't even know what a SAR was, let alone find my account. I had to hang up as he wanted me to hold and decided to contact the big guns.

    No surrender!!

Hi all, does anybody know how much time banks (lloyds tsb in my case) have to pay you once amounts and agreements have been returned and is this the same for all banks. Thanks in advance.

    YEAH! THEY PLEASE THEMSELVES..FULL STOP
Seriously my son sent his off the same time as mine in May,we both received our calculations within a day of each other,i was paid within two weeks of my offer and my son is still waiting for his and this has been since August, its an absolute disgrace, well Lloyds TSB are,if my hubby goes a 1p over his business overdraft, there is a letter there the next day with a massive overdraft charge on it,so they are certainly on the ball with things that concern there own business.
  • just a quick enquiry,if someone can help please,my husband had a decline from Barclaycard.saying its his word against there's regarding telephone call stating that he had become self employed in 1998,although stopped ppi till about 18 months ago,as he did not realise that it would not pay out, according to Barclaycard they said they do pay out on self employed,i do not think this is correct at all and i think they are b**llsh*tting, they said this is there final letter,
we have written back to them at least two weeks plus ago,and registered it,but no reply from them.
Also my daughter has had the same from Virgin credit card, stating that it was explained to her, which is poppycock,as she took it out online, she believed it was an opt out system, again sent saying it was there final letter, and again we have sent details that she would be paid from work and really good benefits for 6 months plus, again they have not replied, shall we give it a little longer,or now send all details to the Ombudsman

    Thanks all
  • It would be interesting to know just how many have been payed out by Lloyds?

I wonder if it would be worth organising some sort of event, to let Lloyds know just how angry and dissapointed people are.

As the previous post says they are quick enough to take cash off us when we go pennies overdrawn but are still withholding thousands of pounds from us as individuals.

We may need to take action at some point i fear!!!!!!!!!!!!!!!!!!

Clearly these disgusting banks are now knowingly using delaying tactics and referring people to the FOS. The time will come that the FOS will be unable to function.

    THE LETTER
Below you will see a letter that YOU should send to Government, your local MP, the FSA, The media and anyone you can think of who will show interest. Email it or send by post, MAKE YOU VIEWS KNOWN before these banks clog up the FOS completely. That is their tactic, so far its working and it's UP TO YOU TO CHANGE THIS, WE WILL IF EVERYONE SENDS THIS LETTER ... THANKS

    PPI Reclaiming Discussion part 4

There are over 1000 pages all relating to PPI and re-payments

Since the Court ruling earlier this year, whilst banks have little option but to repay to consumers, there is a very noticable trait/pattern happening with the way these banks are now handling complaints. There is a huge increase of consumers being told to contact the FOS with their claim/complaint.

I understand now that the FOS are receiving some 2500 complaints a week and resulting in a huge backlog which as the FOS say, could take over a year to clear.
This clearly is detremental to those in hardship who are desperate to receive monies back, stolen from them by the banks

It appears that whilst banks are paying out, it is not a bottomless pit for them and therefore they are now knowingly using delaying tactics and rejecting claims and referring to the FOS ?

I would even suggest that the banks are now running a cartel between them to use these stalling tactics.

The worst offenders in this "cat and mouse" game are
    1: ROYAL BANK OF SCOTLAND
    2: LLOYDS BANKING GROUP
    3: CAPITAL ONE
The smaller institutions also play this game

These banks are fully aware that there is no other avenue for the consumer other than place their complaint with the FOS and they are using this service for their own means to delay payments even though they are aware that there is a huge rise of upheld complaints by the FOS. The more these banks can refer back to the FOS creating a backlog, the more time they have to pay back monies stolen in the first place.

You are of course aware that the banks have committed fraud on a major scale under The Fraud Act 2006 ?

A financial penalty should be applied to these banks if they have rejected a claim yet the FOS has upheld the same claim.
If the penalty was big enough, it would stop banks rejecting Adlib to suite their own purposes.

This method of trading should be outlawed by the authorities as it is not "in the interests of the consumer", It is certainly not in the interests of the FOS if they have such a backlog that could take over 12 months to clear. The banks wil ensure that the backlog grows and grows.

We are already seeing severe reaction to the banking industry with the protests,

It is indeed the responsibility of the Government and the Authorities such as the FSA to put an end to such mal practice the Banks are using against the consumer.

What are the authorities currently doing about this under the Fraud Act 2006
