    Hi,
I am looking for more help please,
Got a letter in this morning saying they are unable to uphold my complaint:-
After considering the information and documentation available to us...I can assure you that that I have fully investigated the sale of PPI using any relevant documentation held by us.

As part of my review I have considered whether you were eligible for the policy, if it was suitable for you in relation to PPI policy when you took it out. I have also taken account the concerns you raised in your complaint as a whole to ensure we acted fairly, taking into account any other relevant circumstances or information that may be available.
As a result I am satisfied that that there were no issues with the sale of the PPI attached to your credit card.

I requested SAR and the only documentation that they have from then (1996 when card opened) is the application form, no terms and conditions. So I presume they are basing decision on the application form.
This was filled in by a bank employee, Handwriting not mine, however the box is ticked, not by me I may add.
The signature box was on another page which I have obviously signed. I was filling in documentation for mortgage at time and got credit card as part of that deal (was guaranteed for mortgage customers)So filled in a few forms that day.
I was on rolling temporary contracts at the time, employer had to write a letter stating how long I had worked there etc for mortgage purposes - they accepted this.
My complaint was I didn't ask for it, nor wanted it.
I don't recall ever getting asked about PPI, I never asked for it, the limit on the card started of at £1000 and was very rarely used, latterly 7 years later, I used it and it was at its max.
I got into financial difficulties and had trouble paying the minimum payment, it is not until I phoned in 2008 with regard to payments, the advisor made me aware that I had this insurance and should cancel it, as was paying aound £50 to it.
I know that I must appear stupid, as this was on my statements, I thought it was compulsary.
If I had known it was optional, then I would have cancelled it years ago, because I was really struggling and this was adding £50 to my mimimum payment.
The complaint has been left opened at present I have the option to phone and redress some of the issues that have been raised.
Do you think I should follow this up, do I have a case, the PPI was added without me asking for it?

    Can anyone help, please.

Hi, this is nearly the same as why Barclaycard rejected my claim. I contacted the financial omnibusman and explained that I have always had PPI on loans and credit cards and I thought it was compulsary and no-one ever told me that it was optional and when I got into difficultys with my payments I was never offered the option of looking into whether I could claim on this insurance. The lady on the end of the phone took all my details then sent a form out which was already filled in using the information I gave her over the phone, I had to attached a copy of my questionaire that I sent to BarclayCard and a copy of my rejection letter and they are now investigating this for me. May take some time to find out if I am successful (has been about a month now) but even if I still get refused I know that I have done everything I can to try and get some money back. I hope you will do the same. Good Luck:)

  • Hi everyone, I'm a long time lurker, first time poster!

Just a thought I would share my success!

I sent in 3 claims (questionnaires downloaded from this website) to Lloyds back in July. Two of those claims related to loans from 2001 and one for a loan in 2003. I also sent a claim to Halifax for my credit card.

I received letters today from both Lloyds and Halifax offering me a full refund of all premiums paid plus 8% statutory interest for all my loans and credit card. Refund from Halifax totalled £743.75 (£358.81 Premiums paid, Refund of interest paid £273.81 and 8% interest £111.13).

Lloyds offered me a total of £2738.95 (Loan 1 £246 premiums, 8% interest of £184.65. Loan 2 £727.92 premiums, £850.49 8% interest and £729.29 early settlement difference!). As an extra bonus, Lloyds also checked the credit card account I had with them years ago! I didn't include this in the initial claim because I...er...well...forgot!! I'm also getting a refund for all premiums paid plus 8% interest, totalling £197!! :j

I am absolutely delighted to say the least. But what does surprise me is that I didn't have to fight for it. I was expecting the standard fob off letter at the end of the 16 weeks. All it cost me was a few first class stamps! Please don't be put off claiming for old loans. I added those loans from 2001 on the off chance I would get something back...it worked!

Just like to say a big thank you to everyone on this site. If it hadn't been for you guys, I would never have sent those letters!!

hiya - congratulations on your offer letters!:j

i dont want to burst your bubble but a lot of people have had their letters offering money! the prob is LLoyds in particular dont seem to be handing over the money!

so providing you arent hoping to get the pennies back for at least 8 weeks you should be happy... if not this is where the frustration begins! boooo!
  • It's not just banks though ............

I've recently had moderate success in reclaiming PPI on behalf of my partner's 84 year old mother who had accounts with 'Very' (formerly Littlewoods) and Studio.

I have to credit both of these organisations for their speed and efficiency once the claim was agreed. Refunds of £350 and £400 respectively and an admission that, at her age, she should NEVER have been sold it anway!

The one fly in the ointment was actually getting through to both organisations on the telephone. Bliddy nightmare !

Thanks MSE for inspiring me :T

Well done on your success :T:T

I think I'll be giving Halifax another call next week. I have received 2 letters from them. The first acknowledging my complaint. The second saying they'll sort it out in 16 weeks and that's it. I called them after the 16 weeks was up and a man told me a payment process had started on 21st September (a month ago) and that's been it really. No update or nothing. I wouldn't mind if they were keeping me updated along the way - don't even know how much for - 2 loans and a Credit Card (loans paid off early) :(

Well I phoned Lloyds yesterday and was told they had sent three letters out and that the claim wasn't being upheld. Asked for the letter to be sent again and surprise surprise it arrived this morning. It basically says "As a result of this review, I am satisfied that there were no issues with the sale of PPI attached to you personal loans". What should I do now. Any advice please.
Hi there, what were the reasons they didnt uphold and have they said this is the final response?.
If it wasnt the final response, then you need to get back to them and ask them to look at this again,as you were mis sold this ppi.

If it was the final response you will have to take this to FOS and just to warn you,you may have to wait for up to 2 years,it could be sooner, but you should be aware.
