    Same here with OHs BC. He has written back asking them to reconsider - all depends on the T&Cs your hubby had in place at the time. For OHs terms define self employed as - "actively working alone " - he wasn't as he had employees; for unemployment benefit it says "claiming JSA" - he wouldn't have qualified and also if he was off sick he would have paid himself from the business. BC have also quoted that the sales process used at the time was correct - he doesn't remember speaking to any one so he's asked for a transcript of the telephone call.
    I'll let you know of the response he gets.
    BC have also rejected my claim even though I worked in the NHS and had all the benefits such as sick pay etc so I'll be writting and asked for a reconsideration as well.


    Hi Dizzie,we are also writing back to them tomorrow,i think they are making new rules up at present,my husband as employees,and also does not pay the stamp for JSA,so he could not sign on either,and yep the same as us ,my hubby as to pay himself out of the business.If they still refuse it will be going to the Ombudsman.

    Good news, and well done.

    I am currently waiting three letters regarding figures concerning three Halifax CC's-all upheld. Wish they would get a move on though...had these cards over 4, 6 & 8 years all with PPI. one of them was upto £17750 until I paid it off- so looking forward to a bumper payout on this one alone....:):):):):)

  • Nothing Pigs had my cc offer today but no loan offer i only sent my complaint letter for my cc in August and they have done calculations already i would of thought it would take longer to do cc claims than loan ones??

    fingers crossed they did my loan one at the same time??

    I sent back my acceptances to Halifax for 3 CC's and a few loans between the 26/08 and 02/09 and have only just received a letter with figures for most of the loans. Still waiting on the CC's and one more loan though.

    Barclaycard seem to be worse though as they have produced figures for me but it looks like I will be waiting the full 40 working days for payment-via bacs..:(:(:(:(

  • Having recently receiving a letter on 23.08.11 saying I would be getting 2995 for 15 loans as these did not end up full term loans that is why I am being paid this amount and also would not be receiving it till 40 working days:mad:

    Has anyone heard anything from Halifax lately and the types of timescales they are working to after sending back signed acceptances??

    Hey - i spoke to them friday and the lady i spoke to said they are telling everyone 6 weeks from day of acceptance received.

    What were you reclaiming: PPI on credit card I paid off about 5 years ago.

    Who was the provider: Lloyds TSB

    How much did you get back: £1,221.96

    Did you get it back after a letter or did you go to the Financial Ombudsman: I wrote one letter using the template from this site.

    And then write your brief reclaim tale: I dragged my heels on this as I did not think that I would be successful due to the time that had lapsed. I took the plunge and did it anyway. I was only expecting about £200 but received a letter about three weeks ago stating they are paying me £1,221.96. I received the cheque on Friday and paid it in on Saturday...happy days, thanks Martin :beer:
    What should I do with the windfall? See link below to another thread

    Well done on your success!:beer:

    So basically they are saying as you settled early on each loan, one to pay off the other, this is the full amount of the whole 15 loans.

    When you settle a loan, you should receive back all the premiums you have actually paid, interest also paid on each monthly payment, and 8% interest, so they should calculate each one the same as the FOS calculation guidelines.

    When you settle a loan, they may have also reduced the balance of each one on settlement which is part of the ppi, so the remaining of it plus interest should be refunded directly to you.

    And if taken one loan out to pay for another, I assume the ppi would also be carried over to the next.

    If they have not provided you with a detailed breakdown, I would ask them to send you one.
