PPI Reclaiming successes and failures

Hi everyone,
Although a newbie have been "lurking" for a while and wanted to share my expereiences with you all.
So far I have had 1 success for myself and 1 fail for OH. Success is RBS loan. I took loan out in 2005 and paid it fully early 2009. I sent a claim last December (before I saw this site), had a JR holding letter then, letter making me an offer of just shy of £7,500! I sent signed acceptance off end of July and received cheque early September so I agree that it must be 28 WORKING days.
With OH's claim it was to MBNA for credit card PPI. I sent in claim stating that he receives full pay then half pay blah, blah and they sent a final response WITHIN 2 WEEKS saying you knew what you were doing as you ticked the box. Well, we weren't very clever because OH was made redundant in April 2009 and we never made a claim on it! (We stopped it earlier this year when we became aware of the problems). Needless to say this will go to FOS. I am also currently awaiting information from MBNA for a SAR I sent in a month ago as we also had a loan with them.

We don't normally post on this forum, but wanted to say a huge thank you to everyone here and in particular Mr Lewis for his support of the consumer.
His encouragement spurred us on to make multiple claims to LTSB for PPI which failed back in 2006. Of the 3 live claims for PPI we have had 2 confirmed with a firm offer of £3.5k for one with a similar amount for the 2nd. We are waiting for the a decision on the 3rd loan.
The success of the first 2 reclaims was due to the option on the loan agreement to opt for PPI was populated with a pre printed 'X'. This was not hand written. This was prior to signing the agreement. In addition to this LTSB did not as my wife or I of any pre existing medical conditions nor if we have company sick pay which would have been paid for 12 months.
It was telling that when we requested another loan once all others had been paid they refused as we did not want PPI. This was in 2007.
Mr Lewis has changed our lives for the better. We could not have coped if it was not for the advice provided on this site.

Did the other give you an opportunity to write back to them?
I take it this was the final decision if they suggested the FOS.
I was going to say otherwise is to give it another go by giving them 14 days, and give further details, tell them if you were aware of the policy in the first place then when your OH became unemployed then obviously he would have tried making a claim on it, and tell them ticked for or not, it may have been the fact that you were told you had to take it to have the credit card, and obviously the staff member who sold it either had no experience of how to sell the policy, and/it was not sold in your best interest.
Its up to you of course, but fingers crossed for you anyway, good luck.;)The one and only "Dizzy Di"0 -

Hi Trish
Have you tried writing to them, and ask them to reconsider, and also give the information as you have done on your post above.
I would give them any further info that you think that may help and tell them your not happy with the decision made and feel its not investigated properly.
Give them 14 days and if you hear nothing, or if they do not change the decision, move on to the ombudsman, good luck.;)
