I have recently claimed from Barclaycard for refund and interest re "Payment Break Plan" payments.
They paid pretty quickly, £597.23, for payments going back to June 2005.
I replied that I had had card, I believe, from 2001 originally Providian, and that payments should date back to then.
They have come back with they only hold statements for 6 years and this is their final offer.
Although their are no statements back to 2001 should Barclays refund to that date and has this been clarified with the Financial Ombudsman?
    Thanks

    Hi there

If you have any copies of the statements going back prior to the last 6 years, you could send them copies of these and still ask them to reconsider, otherwise its knows they do this - going by the last 6 years.
Do you have any statements prior to the last 6 years by any chance?

Will have to have a dig around and see what I can find, but doubt that I will find all statements going back to 2001.
  • Ok thanks N!
Thought as much, will give it a go and see what happens!;)
    Cheers!

    Hi Phil

We were only with Firstplus for 18 months we ran away from them as quick as we could, what about you are you still with them?
Hi Nutty Nat yes we are still with fp its quite a big secured loan dont think we could get away from them--can't believe how much we are
paying for insurance that we didn't really need
  • Yep, i thought as much. Well i'll give it a go and see what happens. Some of the accounts are settled but one is active but i cancelled the PPI a while back now when it all came to light about PPI claims!;)
The loans as you know were from 1998 and 2003 so will write off to the DPA department and get some info and go from there!
    Thansk again di!

    Hiya:D

Is this account active or settled?
You can still reclaim either way it makes no difference as such, but if a settled account they should refund you all the ppi you have paid, interest to each payment and an extra 8%, they should therefore calculate to the same guidelines as the FOS.

If the account is still active, then they should refund you what you have paid to date with interest and again the extra 8%, and they should remove the ppi, so you will only be paying for the normaly card payments without the ppi.

However, I am not good really in actually explaining on the calculations lol, but that is how I see how its done.

Good luck and go for it x;)

Hi we got away from First Plus as soon as we could too!! we remortgaged, they were not happy and were really unhelpful when it was going through. But anyway we have had an offer from them and are now awaiting the cheque - the offer was for around £19,000 so we really did beat First Plus in the end!!!
  • Hi everyone.

Along with many, I got a letter from LloydsTSB saying that they would be settling my PPI claim.

I had a loan I took out in 2002 and which I missed 2 payments on in 2005 and then was settled by taking out a new (current) loan ( without PPI) in 2005 and on which no payments have been missed.

I just wondered if they could use the PPI repayment amount to reduce the current loan ? I would prefer that they didn't. On the acceptance form I signed & sent back, I ticked the box to say that I did not want the repayment to appy to any arrears, but I'm fretting a bit that they could apply it to the current loan.

Thanks for any help / advice

Hi there, you get the ppi total back, they will take off the rebate they gave you when you settled, you then get the 8% plus the 36 ppi monthly payments you made with interest.

Was the ppi interest paid each month,or was it fixed over the term of the loan?,if it was fixed, the interest on your monthly payment is included in the monthly ppi payment.

What figure have you been offered?,if you post the calculations up,one of our maths wizards will work this out for you.

Thanks Amersall and also to Niggly for his reply earlier in the thread.

I haven't been made an offer yet, only had word that they have agreed to repay all the PPI on two loans and one credit card.

    I can give details on the my big loan if someone would be kind enough to work roughly what I might get back? The details are as follows;

    Loan agreement date: 17/2/06
    Loan period: 84 months
    Loan amount: £15,000
    Interest on loan: £4,994.52
    PPI amount: £6,385.50
    Interest on PPI: £2,125.39
    Monthly repayment: £339.35

    The monthy repayment can be split as follows;

    Loan capital repaid: £178.57
    Loan interest repaid: £59.46
    PPI repaid: £76.02
    PPI interest repaid: £25.30

So the monthy repayments I made included £101.32 worth of PPI and interest.

I settled the loan at the end of March 2009, I think I made 34 payments as HBOS give you a three month holiday at the start of the loan. I called the HBOS loans helpline yesterday and was advised my settlement figure was £12,804.86 which included a PPI rebate of £1,850.38.

If anyone can have a go at working out what my entitlement approximately might be I would be most grateful! :)

As far as I'm aware, they only apply money to the loan in the event of arrears / defaults.

Might be worth giving them a call to double-check and put your mind at ease.
