    Hi,
Got a rejection letter from Santander about misselling complaint I put in, store card was opened in 1993, when I was 19. The card limit was £240.
However due to the length of time thay say they can't find original documentation.
My complaint was the I didn't realise it was optional (I didn't really elaborate further, totally my fault and coupled with the fact they are not mind readers) although now I realise this has made it appear as if were asked about PPI which I definately wasn't. In hindsight I should have expanded ie that although I seen it on statement I thought this was complusary and that it came automatically with card. I got template letter from Which.
Because of my stupidity they have rejected on the following:-
Process they had in place was made clear that it was not compulsary and it was appears it was made clear to me and that I elected to take insurance.
policy summary etc sent out, 30 days to cool off and that this time would let me compare policies with other companies.
In relation to sales process there was no requirement for them to record sales process and so they have no way off knowing what took place, but if I had could have complained at that time if i was unhappy with sales process.
I just remember being asked in topshop if wanted to aply for a topshop budget card (no longer in use)being asked the usual questions and then being asked to sign. I don't remember ticking/crossing any boxes, am I deluding myself that I have vailid complaint?
Is there any way I can redress this?

    Hi there

Personally I would write back and ask them how did they get the information then, if they say they made it clear and so on, they must have had some details to go on.

Some will change a final decision but its rare, you could ask them to reconsider and expand more on this/with further information.

Give it a go, ask them to reconsider but to let you know by 14 days, then confirm if you hear nothing or if they don't change the decision in your favour, you will consider taking this matter further.

You could contact the FOS and see what they suggest, if the business were not regulated at the time you taken out the policy, they may suggest the underwriter/insurer direction of the company instead as they would have probably been regulated.

    Good luck.;)

All Halifax/HBOS acceptance forms signed and sent special delivery. :T:beer::j:D

Now the redress from the loans will be paid directly into my Halifax bank account and the Credit Cards funds will be paid via a cheque.

Can I just ask how long it has taken refunds to be made to people after they have sent the acceptance forms back to halifax?
    :money:

    Hi everyone,

Great to see all the success stories people are getting

Think I am getting somewhere with mine finally.

Sent the questionnaire to Halifax for my loan in March. I got a letter back in May saying it was been investigated then another letter saying they had 16 weeks etc. in June. Finally last week I got a letter saying they would repay and I had to sign the form to accept then they will work out the figures and send me the offer.

Can anyone advise normally how long they waited from this point with Halifax to hear the amount?

Also, I wondered if anyone could work out roughly what they think I should receive so I can compare it to what they say, my details are below:

I took out a Halifax unsecured personal loan October 2004 for £5,000. The APR was 12.7%.

Amount of Credit (Cash Loan) £5,000
Total Charge for credit for Cash Loan £2,577.64
Total amount you pay for cash loan £7,577.64
Insurance Loan (Cash price of insurance) £1,498.44
Total charge fir credit for insurance loan £772.08
Total amount you pay for insurance loan £2,270.52
    84 monthly payments of £117.24
    APR 12.7%
    Loan £6,498.44
Total charge for credit of loan £3,349.72
    Total amount you pay £9,848.16
    Monthly interest rate 0.987%
    Arrangement Fees £64.98

(I was totally shocked when I realized this as I would never have agreed to take insurance at this price and as you can see from the above, a £5,000 loan is costing me almost double with a repayment amount of £9,848.16 in total!!)

    Thanks in advance :)

Forgot to add, I missed payments on this loan, does this affect anything to do with the claim at all? Thanks
