I (well it's my husbands) have an MBNA formerly Abbey credit card which MBNA have upheld the complaint (awaiting the chq). They stated that the PPI paid was £666, I assumed that this was including the old Abbey card although I did think the amount was a bit light.
So would my claim not have included the PPI paid on the old Abbey card?? Should I be making another complaint to Santander?
Hi, you should do what plumfin has done and claim from Santander too, tell them that mbna upheld theirs.

    Hi all,
My daughter has recieved a letter from fos about her claim for missold ppi on an Evans card that was ge money then became Santander. Just to recap Santander gave her the big fat NO as final decision, so we went to fos. They have written back saying they cannot investigate her claim with Santander because the sale of ppi took place on a date before the sale of insurance policies by this firm became covered by their jurisdiction. But they said it may be possible to pursue a complaint through the fos against the underwriter. In this case it is Financial Insurance and the gave this address.

The fos say they have sent details to them and asked them to deal with this matter. They have said that Financial Insurance should reply within 8 weeks with a final response. Sorry this is a bit long winded-lol. What I want to ask is has anyone else been in this position with Financial Insurance and what was the outcome.

    Hi there

Sorry to hear this and yes myself and others, although in my own experience it can take some time, its another avenue to take due to circumstances of similar as your daughter's.

    Good luck with this.;)

From the email they sent me, I would def go back and ask the question,

Please be advised that following a review of this complaint I have identified that MBNA acquired this account from Abbey and that the sale of PPI was made by them prior to MBNA becoming the service provider.
When the account was transferred to MBNA new PPI policy terms and conditions were issued to you and you were given the opportunity to cancel the policy should the new terms and conditions not meet your requirements.

However, as a gesture of goodwill, we will agree to refund the premiums and associated interest that have been charged by MBNA since the date of transfer to be made in line with FOS guidelines upon receipt of the signed settlement. Again, the FOS should contact you regarding this offer.

OMG thanks for that, I will email them in the morning, this is kinda taken over my life at the minute, the excitement of the thought of all this possible money is almost to much for me!!
If it wasn't for this site I wouldn't of had the first clue!! When I get all this money I'll throw a big party with u all as guests lol!

The wait is killing me too and its only been 2 weeks with rbs/natworst..... I just think that it should be pretty cut and dry either uphold or dont ........why does it take them 16 weeks to make a decision you just feel like they are weighing up the risks rather than admit that mis-selling was totally the name of the game.... its the summer get students in to open and sort the paper work.... or something..

They are receiving 1000s of complaints a month.

The decisions aren't taking 16 weeks, it is just taking that long to work through the massive backlogs.

The complaints proocess probably only takes 2 weeks in total.

I am regarding a D Perkins store card, the company above said the policy hadn't been sold by them and referred it back to Santander. Mine is currently with the FLA before going down the underwriters route.
