Only now been managing to post, been sorting out my paperwork yet again - with a case that has been with the FOS for a few years now, it seems now it will be passed on to the ombudsman, the adjudicator I believe fails to understand how my actual case works.

I am glad really it will be moved on to the ombudsman, I realise it's a complexed case, but despite sending all the proof he asked for previously, he still doesn't get it.

Arh well, another 3 years on this one I expect lol.;)

    Hi all,
My daughter has recieved a letter from fos about her claim for missold ppi on an Evans card that was ge money then became Santander. Just to recap Santander gave her the big fat NO as final decision, so we went to fos. They have written back saying they cannot investigate her claim with Santander because the sale of ppi took place on a date before the sale of insurance policies by this firm became covered by their jurisdiction. But they said it may be possible to pursue a complaint through the fos against the underwriter. In this case it is Financial Insurance and the gave this address.
    Mr Tony Keane
    Financial Insurance Company Ltd
    Building 11
    Chiswick Park
    Chiswick High Road
    London W4 5XR

The fos say they have sent details to them and asked them to deal with this matter. They have said that Financial Insurance should reply within 8 weeks with a final response. Sorry this is a bit long winded-lol. What I want to ask is has anyone else been in this position with Financial Insurance and what was the outcome.

    Hi there
I'm in the same situation but at a bit more advanced stage now. Financial Insurance will send you a letter stating they feel they are not responsible for the selling of the insurance and this will be their final response. You will have to then return back to the FOS to complain against Financial Insurance. The FOS are fully aware of the situation and are awaiting the outcome of test cases to see if the underwriter are responsible. I was told by the FOS that this will be a long process and don't expect anything this year. Sorry about the negative news but hang in there;)

Good luck Di, after all the help you give out it's a shame we can't do more for you on this one, can we petition the FOS to look at your case first and foremost for service rendered:rotfl:oops maybe shouldn't word it just like that:A

    • What were you reclaiming: PPI on a loan
    • Who was the provider: Egg
    • How much did you get back: £6780
    • Did you get it back after a letter or did you go to the Financial Ombudsman: A letter and 8 week wait.
    • And then write your brief reclaim tale
I had made my complaint to Egg 8 weeks ago. They informed me when they received my claim and again after 4 weeks to keep me informed. Yesterday, after exactly 8 weeks, I received a letter informing me that they would need more time, until 15/08/11, and that I could go to the FOS if I wanted to. I decided to wait...and then today I received a cheque through the door.

    I am absolutely delighted:j.
I just want to thank all the usual suspects on here, you know who you are:A. And to everyone with claims ongoing....good luck.

    Chris.

Thats fantastic, Chris! Well done.
If only Lloyds TSB processed claims that quickly. :p
    2018 wins: Hong Kong holiday

Ok Amersall and Di, the Norton response has arrived, about 5 pages of it, they state they have followed all the guidelines set out by the fsa and a their rep followed them as per word, they state it was optional,(it does say this) they state we had time (30 days cooling off) it states we were informed it was a single premium policy which was put onto the full loan and would attract interest over the term bla bla they also state they can not provide the a disc with the calls they state archived calls around that time are unrecoverable as the data is corrupt, it all seems like legal this that and the other, they also state that they only had one product available.
