  • Hi - came home from work today to a shock letter from HSBC!!! I wasnt expecting anything from them until 14/7/11 as that was the next date I was due an update, and then was only expecting a "8 more weeks" type letter but they have made me an offer! They said they are only going back 6 years and if I had any statements or proof this account went on longer they would look at it!! But alas I havent (account was opened around 1999/2000 but dont keep statements) but nevermind - its all money we wouldnt have had if it hadnt been for Martin Lewis and this site. They have offered me £1430 - which is very nice thank you HSBC!!!

I am wondering though they have asked which bank account I want this money paid into (I requested my HSBC bank account cos I thought it might go in quicker) but I do wonder if they will pay off some arrears on the credit card and not put it into my bank. I am hoping that with them asking about which account I want it in they might pay it straight in to my account - we could just do with a bit of spare money at the moment with husband being on short time working, etc.

Anyway I am pleased we have got our first offer and sooner than expected!!! Thanks everyone fo your help. I will keep you informed of the rest of our claims.

By the way I signed the form and went straight out again to post it off!!! Then afterwards I thought maybe I should have sent it recorded but the post office would have shut by then and the post box I put it in had a late pick up!!

Wow! Brilliant news, when did you submit your complaint to HSBC? I've got a loan and a CC complaint with them which they received on 27th April. I did receive a letter stating that my loan ppi would be resolved by 22/07 but I chased it again today and the HSBC Complaint Team couldn't find it on my records and virtually said no such letter exists! I'll fax it to them tomorrow and see just what is going on

    Well done again!

    Hi DWM,

    firstly Congratulations!

    :D

Secondly, I doubt the bank is going :Dout of its way to help you get more money on this, so it may be worth you sending them a SAR for information ? - this might throw up proof the account existed in 1999/2000 and the interest alone COULD be worth more than you have already received!

I would just send a SAR for ALL data that HSBC hold on you?

    YOUR NAME
    YOUR ADDRESS

    THEIR NAME
    THEIR ADDRESS

SUBJECT ACCESS REQUEST UNDER SECTION 7, DATA PROTECTION ACT 1998

    Dear Sir/Madam,

I respectfully request that you supply any and all data you hold relating to my person at the above address and the following previous address:

INSERT ANY ADDRESS LIVED IN SINCE 1998

This data should include (but not be limited to)

    - Copies of any and all credit agreements (together with terms and conditions found therein and any alterations made to those terms)

    - Copies of any and all insurance policies in relation to my accounts, together with full terms and conditions relating to such policies

    - A full list of any and all transactions (debits and credits)

    - Copies of any and all communications made between us

    - Copies of any and all communications made between you and any third party in relation to myself and my accounts

    - Copies of any and all screen notes made by your staff in relation to myself and my accounts

    - Any data not mentioned above, but held by you

I enclose a cheque for £10 being the maximum amount payable for such a request and ask that the data be supplied within the regulatory timeframe of 40 days

    Yours faithfully

    Dizzy

Had a reply from cap 1 to say they wont uphold my complaint as they said i pre-ticked the application form to request ppi, i was looking at the application that they sent to me and the tick for ppi is inconsistant with all the other ticks on the form. So i have now sent a complaint to the ombudsman and hopefully they will see this then uphold my complaint. Has anyone else had the same problem with Capital one credit card?

    Hi Dizzy
    :T
Well done on the First win:j:j:j
But have HSBC been honestwith you ?
If you have held an account with them since 1999 why can't they find any record of it ?
Call me cynical but the if first six years of the account were the same as the last the've still got at least £1430 of your money.

When I tried to claim off Capital One going back to 2001 giving them my account number they were able to send me two days later, a copy of my application form from 1999 showing I ticked the box for PPI so they rejected my claim.

Thanks to them they have now given me the proof of who I was working for at the time which proves that the PPI was missold its now with the FOS :beer:

The point I am trying to make is that surprisingly banks can find all sorts of information to prove they don't have to pay us, but when they do have to pay us they can only find information going back six years.

Is it worth investing £10 on a SAR request to HSBC to get hold of the MISSING ? information, according to your letter they say they will look at it again if you can prove it was in existance earlier.

£10 to win another £1430 looks a good punt to me ;)

Must admit mine goes back to September 1999 and the tick on mine does look a bit dodgy, I seem to remember being asked some questions by the salesman who was filling in the form.
On my form there are two questions in a box
1 Would you like a cash advance Yes/no
2 Please enroll me in Capital One PPI scheme Yes/no

The wording of both questions to my mind is to get a yes tick.

The most important thing is that the employment details they have for me prove that even if I did tick the box and not the salesman I would not have been able to claim:rotfl:

    I can't remember ticking the box ?
    Can I Claim ;)
