Try sitting it out now if you can, but I am aware BH email address could be the same as Lloyds, you could email them to check, in this case the CEO would be the same as well.
Give it a go and see what they have to say, good luck.

Sorry to hear of the messing around.
The FSA have apparently given banks longer to deal with complaints because of the backlog, so if yours is one of the ones that have been with them the longest they aim to deal with them in date of order, check the link below this may help.

The letter of options would be that you could either wait, or complain to the FOS I expect, but I would sit it out, the longer you wait that interest will add up and I'm sure it will be one in your favour or you would have heard by now, that is my personal opinion anyway.;)
Now I have read your link I am none the wiser, think I am a bit thick,. I put my claim in on 21st April so am I the before the court case or after? My friend did fail in her attempt so you could well be right in what you say in your personal opinion,

I paid off a loan in November 09 but am unsure whether I paid PPI on this and no longer have the paperwork. In the first place, have used MSE's template to request my paperwork, and included a cheque for £1 which I note was cashed yesterday. However, today, I receive a letter from them saying: ""Where there is no sum which is, or will, or may become payable under credit agreement, then the obligation to provide documentation under section 77/78 of CCA 1974 does not apply. Therefore... we have no obligation to provide you with a copy of the documents... have returned your £1 cheque". The cheque has NOT been returned but cashed. Obviously I am going to write to them to point out their error regarding the cheque - but are they right? Can I not pursue this one? Anyone with any experience of this? Thank you.0

If you did not get a letter putting you on hold then they will be addressing complaints as usual, but the FSA have granted banks more time to deal with these claims, but it will be dealt with.0 -

This seems to be what they come back with if the account is closed.
However, if a SAR although these cost £10 cheque or postal order they must comply by the Data protection act (DPA), comply by 40 calendar days and provide you with everything they hold on your account going back the last 6 years.
However, just as long as you have the account number and you know you were paying and mis sold the ppi, you can still continue to make a reclaim.
Many of us have still been successful with lack of paperwork.
More on SAR if required but its optional of course, good luck and ask for further help if also required.

Nah your not at all thick, it does sound confusing doesn't it? LOL.
I think what the FSA are saying is that banks can have a bit longer to deal with these complaints because they are overloaded with backlogs, (their own fault I know), on that FSA link I posted it does also state when the banks should send out letters on decisions.

Firstly, the SAR letter doesn't seem to quite apply. I don't have the original loan details, and I can't remember if I paid PPI on it, so to find out was going to be my first task. I also didn't have/don't have the loan account number, but they letter I received today detailed the account number, and acknowledged that I did have a loan with them. If I just want to find out whether I paid PPI (which would have been mis-sold as I have always been self-employed, and I also had other death/critical illness insurance that I know I was not asked about when I took out the loan) then I would go forward and seek to reclaim the PPI if it was applied. But are they right in saying they don't have to tell me anything - and as they have in fact cashed my cheque, are the obliged to do so anyway, do you think?0

By the way, I had a claim dealt with and a £1800 paid to me within 4 weeks by Capital One! Is that a record?0
