    Looking for some help please. I had a Dorothy Perkins store card and a Wallis one. Both had their balances cleared sometime between 2004 and 2006, but the account remained open (I never asked for them to be closed though I believe they as in both of them wrote to me to say they were closing them due to inactivety in 2008 or 2009). These have PPI on them but written as insurance, can I still claim? Who would i write to?

    Firstly, the SAR letter doesn't seem to quite apply. I don't have the original loan details, and I can't remember if I paid PPI on it, so to find out was going to be my first task. I also didn't have/don't have the loan account number, but they letter I received today detailed the account number, and acknowledged that I did have a loan with them. If I just want to find out whether I paid PPI (which would have been mis-sold as I have always been self-employed, and I also had other death/critical illness insurance that I know I was not asked about when I took out the loan) then I would go forward and seek to reclaim the PPI if it was applied. But are they right in saying they don't have to tell me anything - and as they have in fact cashed my cheque, are the obliged to do so anyway, do you think?

    Normally requesting for the agreement is the first step before making a reclaim, so you can request for this if you have no other details of the loan, the account number or if you did not know you were paying for ppi.
    You do not have to request for this if you do have some details of the account.

    Basically, even though the loan is settled/closed, they should still hold the main details of the loan from the last 6 years.
    Many of us have been in the same situation where the loan have been paid off, but the main details they should still therefore hold if the loan was taken out in the last 6 years, they are expected to hold data for that long.
    A SAR is a longer version to request for all data on your account and not just for the copy of the CCA (Agreement). This request they have 40 calendar days and for a copy of the agreement only is normally 12 days.
    Any problems, in receiving your data you can make a complaint to the Information Commissioners Office (ICO) or ask them for advice.

    In regards of the reclaiming, you complete the reclaim questionnaire as on step 3 below.

    Complete and keep a copy for yourself, send one to the head office or complaints dept of whoever set up and sold you the account, allow 8 weeks for a decision.

    By the way, I had a claim dealt with and a £1800 paid to me within 4 weeks by Capital One! Is that a record?

    Yes you can still make a reclaim if you have reasons for being mis sold, it makes no difference if active or settled.
    You pursue the head office or complaints dept of whoever set up and sold you the ppi.

    Below is the questionnaire to make a reclaim,complete and send, keep a copy as well, and allow 8 weeks for a decision, good luck.

    I would write to the ones on the statement.
    My son was mis sold a burton's store card ppi when he was a full time student, and he used the address on the back of the statement. Not a daft question, normally its a case of pursuing the ones who sold the account, but store card wise I have been informed the address as shown on the statements.

    hi there thought id update complained to HSBC in sept 2010, then was put on hold like everyone else so i went to ombudsman after 8 weeks that was dec 2010 had a few letters from them keeping me updated .Today i got a phone call saying ive been assigned a person to look at my case for my loan and an old credit card with ppi which i knew nothing about. hope this is a step in the right direction for getting my money back
