I have recently written to my bank requesting for my original loan agreement details.

Today i received a reply stating that they have misfiled my loan agreement and despite searching their records were unable to locate these.

They have however provided a statement supplying some information regarding the agreement.

What should be the response to this letter?

    Regards

    NICK

    Hi Nick

You can still make a reclaim without the need of the paperwork really, having the account number helps.

Out of curiosity is this loan active or settled?
If the account is still active they should still provide the copy of the agreement, as they should still hold this on file.

Did you also send the £1 cheque or postal order payment for the request of the copy of the agreement?
If they were unable to supply it, I would assume they should explain in writing why they could not provide you with this and return your payment.

I would though if mis sold the ppi, continue to make a reclaim anyway, its been known that these agreements suddenly appear when you receive the letter from them.

To make a reclaim, you pursue the bank head office or the complaints dept if they have one.
What is the name of the bank?

And there is a reclaim questionnaire that replaced a template letter on this site, you will find this below link - stage one of reclaiming.
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#reclaim

You can write a letter in your own words to make a reclaim if you want to, by asking them to refund you the ppi, plus interest because you believe you were mis sold .................then give your reasons, then ask they get back with a decision by 8 weeks.

So do either of the above, and keep copies of everything in case you need to refer back to this again at some point.

I have always been sold ppi with my bank loans, and am dealing with my last 2 via lloyds tsb which I do not have much paperwork for, and these are older loans from late 90's going into 2000 etc, I was successful with the other reclaims made with them on the more recent loan ppi, so despite not having much paperwork for these last 2 they have not turned them away and are still investigating.

    Good luck.

I think it was last October for me too. Don't have the paperwork in front of me for exact dates. I've already had a claim processed and paid up by RBS, but not heard a thing about others. There doesn't seem to be any set timetable, and each case just trickles through the system.

Hi all, was wondering if anyone has had any success claiming back on an Egg card, where Apex now own the debt? They seem unsure of how to deal with it on the phone - they paid up immediately for the loan but are sticking on the card! any suggestions?
    Thanks!
