Thankyou to the people who contribute actively on this site,I started my claim against Picture financial in late Nov, and last week recieved a cheque for 23880.00 which was great!! I didnt think I could do it on my own and did consider appointing an agent, but reading other peoples stories,I thought it best to tackle on my own, so I thank you all again, and advise others to fight back,
I have written a few breaches that may help, if you find the same misselling criteria:
Not understanding the true cost implications of the policy of PPI is a breach of ICOB 5.5.14R
Failiure to establish your "demands and needs" is a breach of ICOB 4.4.1
if you provider has broken the FSA guideline figure of 6.00 per every 100.00 covered
I hope this helps someone else good luck all who are still claiming and very well done to those who have sucessfully claimed!!
:j:jWell done on your win :T

I thought I would report my success as it is quite unusual. The PPI in question was on my late husbands credit card (my husband passed away in 2006), but I knew he had PPI and after the publicity from yourself I decided to give it a try. I reclaimed the PPI in October 2010. He had 4 credit cards all with PPI, I am still persuing 3, but I have had success with American Express. My husband took out the PPI in May 1998, he was not sold it by AMEX, but merely ticked the relevant box when he applied for the card. I received from American Express all the premiums of £1545.53 plus interest at 8% of £923.60 a grand total of £2 469.03. I did not use a claims handler, and did not have to go to the Ombusman but I did use all your template letters, adapted to the particular circumstances.

    Hi after some advice please.

Sent letter to Welcome Finance with regards to loan ppi for loan taken out in 1999 which was settled in 2002.

Not sure if to complain due to loan taken out so long ago.

Reply was " the rules of our regulator (FSA) state that where the complaint relates to an event that took place before 27 February 2003, we are not required to investigate your complaint. Sales of insurance made before this date were the responsibility of the insurance provider, not the broker who sold it."

They have not investigated the claim and this is their final response.

    Can we take this further?

    Many thanks

    Hi Tom

I would give the financial ombudsman service a ring in office hours, they may possibly suggest another avenue as they have done with others in the same position I believe.

    Good luck.

Hi there, ask welcome who the insurer was and try a complaint to them. This may not work, but you wont know until you try.

Thanks did wonder if it was worth pursuing the insurer. Will also contact Welcome to get the insurer details aswell as contacting FOS.

Must just update with my claim against Egg CC ppi (sold online) still waiting for response from Ombudsman, adjudicator ruled in favour of Egg.
