  • Good morning, I wonder if anyone can help me please. I have recently written to HSBC asking them if they could send me Copies of my Load Agreements that i had taken out with them in the last 6 years. I have had a reply off them today informing me they are unable to provide copies of this information as it would have been given to me at the time i took out the loans. Can any one tell me if Banks do not keep records of this information within there system? If they do can anyone guide me as to what to do next.

    Also another question.... Can you RECLAIM your PPI if you have actually claimed off it?

    That is every ongoing claim now confirmed as being on hold over the last week or so due to the JR.

    They have all been on going since September and I have been holding off sending on to FOS 'hoping ' for the banks to carry on looking at claims -:rotfl:

    I now realise(woke up at 4am thinking about this) that this is just another opportunity for them to delay the proceess and that once the JR is completed they will simply reject my claims ,forcing me to the FOS anyway,which they know will more than likely take many months to be looked at / resolved.

    I have therefore decided to get on with it and lodge them all with the FOS.

    Hi and welcome

    They are not actually obligated in keeping copies of the loan agreements unless the loan is still actually active, so if this is still active and not a settled loan - contact them again and make this clear to them.
    I assume you also sent the £1 postal order of cheque payment for the loan agreement request as well.

    The only other way to retrieve the main of your details is by requesting a Subject Access Request (SAR), they must comply by Data Protection Act (DPA) and send all they still hold on your account going back at least the last 6 years.
    You enclose £10 cheque or postal order for this request, and they have 40 calendar days to comply.

    However, just as long as you have your reasons for being mis sold and have the account number, you can still continue to make a reclaim.

    If you've made a successful claim on the ppi, you can still make a reclaim for whatever reasons you have for being mis sold, but the amount owed will be reduced and the chances may be lower, in the link above I believe Martin have explained about this.

    That's a good point - will put bank charges reclaim on hold until redundant !! Thank you !!

    Yes but just think, if you win mis sell you get all ppi back :D:D:D:D so it is all yours :D:D:D What ever you do, dont even think about cancelling the ppi, let it run its course, or mis sell, whatever comes first. As if you cancel the ppi, the bank will redo the loan without ppi and your term and apr will increase. so you will have paid this for 5 years for nothing. Just ride the storm.

    I went round to my parents house the other day and a letter was sitting there. I saw the back of it and it said Welcome Finance. I opened it up and though it was rubbish....... but it wasn't.

    I had reclaimed my PPI and got £2200 back in June 2009, this letter outlined that in fact they had understated the amount owing to me as they had not taken into account previous loans.

    It works out that they have offered me additional compensation totalling £4284.09!!!

    I have sent the acceptance forms in and have spoken to a nice lady in the Brideshead team who are dealing with these errors!! She has advised me that they have received my written acceptance and I will be paid out within 30 days.

    I am getting married next July and although this money wont be used for the wedding it will give my partner and I a great start to our deposit for a house.

    UPDATE- the money arrived in my bank account within 18 working days
