    Had word back from HSBC today in response to my original letter sent some 6 weeks ago.
    They cant find any records of my loan (92 - 97) and have asked that I send them copies of the original agreement and bank statements to prove that I made payments.
    I have the original agreement signed by all parties which clearly shows the PPI 'frontloaded' which I assume is useful.
    However, I do not (I dont think - Im going to have another look tomorrow) have bank statements going back that far - would I really have to produce these?
    I have sent them an SAR request about 5 weeks ago c/w £10 postal order but nothing has turned up as yet.
    Any ideas? - I was thinking about checking my credit report - would it show up on there?
    Who do HSBC use - as nothing shows up on experian.
    They say until evidence is received my case is closed.

    Hi Matty

    A credit report only normally goes back the last 6 years, but if any of the accounts are still active they will hold these details, or if any of them were settled in the last 6 years.

    The SAR should take 40 calendar days, so any problems, as they must comply to this request under the data protection act (DPA), then call the Information Commissioners Office (ICO) for advice.

    I would send the agreement (in a copy only) and if you do have any statements, send copies of what you do have of them, but if not the agreement will have to do.;)

  • I posted before about issuing a PPi claim with Nationwide and received two letters delaying their response.

    After some wise advice from the forum to hang in there I received a letter yesterday and i'm pleased to say that they are issuing a refund for all PPI charges totalling £2,628.46.

    Obviously i'm chuffed as chips with this and now have the option for either a cheque, or be taken directly off the balance of the loan. I will then be issued a new loan without the PPI on it and continue paying this until its finished.

    I thought I'd ask whether they are allowed to issue a new loan and change the interest as my previous loan was on a pretty good rate, nothing like they are issuing these days. Also im planning clearing the loan asap with some inheritance money and im worried that they may stick in a hefty redemption fee. The combination of interest and redempion would effectively make sure they get their money back after issuing the refund.

    Call me paranoid but does anyone else have experience of this?

    Right you do what is right for you is best.
    It seems you do have a choice here, and if your defo receiving inheritance money that will also be of some help to you too.

    I believe banks have their own way of dealing with refunds and if new loans are involved, but hopefully someone will have the answer on this one for you, good luck.

    Firstly :j:j:j:j:j Well done on your win :beer:
    The loan has to stay at the same term and apr, they cannot change this, ring them and find this out first, also ask them for a settlement figure and take it from there.
  • Thanks to all the helpful posters on this forum and Martin I have managed to claim back over £6000 from Lloydstsb, £3800 from Alliance and Leicester and £1000 from Egg :j

    Have been a lurker for over a year and plucked up the courage to start my first Lloyds claim in August after realising I had been mis-sold over and over and reading the encouraging messages from Di3004:T, amersall:T and robbed :T and all the other success stories.

    First sent for a for a SAR (with a cheque) then after getting my info back completed the questionnaire and sent it off.
    Got quite into it after the first one so sent off claims for another 2 loans one dating back to 2001. Didn't even send a questionnaire for Egg just sent an email through their online secure message system as they wrote back saying as the loan was paid off they didn't have to send the info (got my £10 SAR cheque back in the post today lol:rotfl:). It's not always easy and sometimes you have you have to be patient, but it is worth it.

    So far in the last 2 months have banked over £12000 in PPI refunds and card charges and all for a few stamps and some persistence (rang/emailed Lloyds for the past 2 weeks until the money was paid:D).
    Still have 2 with Barclays that were received before the hold was put on so are still being investigated (fingers crossed!).
    We are going to have lovely break in Disneyland Paris next year and Xmas will be a debt free all because I decided to take a chance. Plus our debt has come down by a big chunk.

    Sorry for rambling in my first (and prob last :o) post but if you are lurking and wondering :think:go for it or have started to reclaim and had a knockback:mad: keep going! You never know 'til you try...
