PPI Reclaiming successes and failures

I need some advice. I have had a barclay card for a number of years now and over the past year - I have been on reduced payments due to financial difficulty. But the ppi is still being added to my account. When I went to renew this they asked if I could up the amount I paid I said I may be able to do this next month. I had a phone call last week to pay my monthly payment and they said that I should cancel my insurance then they would consider the reduced payment. Now I'm wondering why all of a sudden they want to ME cancel (and they say they will not accept payment till I do).
Do you think I have a case for reclaiming the ppi I have paid before and after I was reduced payments.

You can give it a go, especially if you believe the ppi was missold, and of course it does not help either if its added to the debt, and now worthless to you if on reduced payments.
First of all it may be a good idea to post about this as well in regards of the hardship side of it on the debtfreewannabe thread below, they have letter templates you can send to your creditors about the hardship and make arrangements to pay what you can, some pay token payments for little while until a more reasonable affordable arrangement can be made.

But also check the info below of mis selling and the checklist, it takes you to the reclaiming questionnaire who you send to whoever set up the policy in the first place, remember to keep copies of all you send and receive as well, in case you need to refer to this at some point.

I actually thought the case was with an adjudicator as I was told it had been assigned to one in January. Any ideas on where to go next?

Hi there, did you pay ppi in the last 6 years , do you have proof of this or did you cancel the ppi and is that why they wont pay you?. Sorry for all the questions but they wont pay you for ppi you have not paid, if you have proof that you paid this ppi (and previous to the 6 years) then that is the info you need to give the adjudicator, i would wait and see what the adjudication team come back with on this one.If you have proof of ppi paid then i would email the ceo of rbs and the ombudsman service. Sorry i couldnt be more help but someone may come along who will advise you on what the next step should be.
Yes I paid PPI on both loans. It was frontloaded onto them and I have all the origional paperwork that I submitted copies of when I first made the complaint. The loans were paid off in full in 1999 and I never made a claim on the PPI. I know it is a long time ago but surely if I have all the origional paperwork they cannot dispute that I paid it. I suppose it is actually a question of their word against mine. I know I never asked for PPI and was led to believe that it was part of the loan. I was also never asked if I had alternative cover, which I did through work. This is so annoying, particularly as it has taken the FOS over a year to get this far and only now is it going to an adjudicator. When they called me in January and asked a number of questions they said then that it was going to an adjudicator! Not sure if I can go through another year of this!
I have written to the CEO of RBS and the FOS and will keep you posted.

Timeline of reclaim - Sent 1st letter May 2009 - rejected by Norton, upheld by FOS adjudicator Nov 2009 - ignored by Norton, upheld by FOS ombudsman Apr 2010, finally received cheque today :j

Hi Guys
Its been a while since I popped in to say hi!! Just to let you know I have (3 weeks ago) received a letter from the FOS in my favour v MBNA for ppi on my credit card dating back to 2001!! I know I had paid 2000 pounds in PPI from mid 2006 so hopefully I will get back a nice sum of money. I have phoned MBNA to find out when I will get this money and just keep getting the same phone monkey everytime who says that the department I need to speak to have no phones !!!! Has anyone got any information that may help me contact someone to push this through ? Any information would be greatDebt Free in 2010 ??? Fingers Crossed:cool:0 -
