    I am in exactly the same position with Marks and Spencer's money with a charge card from 1995 and a personal reserve from 1999. I have chased via the templates since February and M and S have sent me their final stance..a big fat no....I have written to the FOS and they have said they cannot help as M and S were not covered by them at the time and nor where they covered by the GISC.
    I have called Allianz who may have been the underwriters at the time and they have no record of me, but they were not very sure of anything and after 2 hours on the phone I could not find what department to speak to.
    So I requested the underwriters info from M and S and after 4 weeks I have a reply...Cornhill Insurance and at the same time I requested the ammount of PPI paid. M and S would only give me the info from 1994 onwards so I have paid £500 and £900 on both accounts. Now my issue is that Cornhill is a subsidiary of Allianz now so does anyone know what address I would need to write to with regards to this.


    OK yesterday I received a letter from Allianz after I sent the second template to them threatening the Ombudsman

    Letter from Allianz received yesterday stating the following;

    I am sorry that you are still unsatisfied with the decision regarding your PPI policies.
    I regret to inform you we are unable to assist in this matter any further and therefore the letter dated the 20th July is our final decision on the matter.

    So what do I do now. The FOS state that they won'y do anything because M&S weren't regulated and Allianz are having nothing to do with it.

    I take it that Allianz were the underwriter/insurer?

    I would then complain to the FOS about these then, because these I'm sure would have been regulated even if M&S wasn't.

    Some of us have ours with the FOS right now, due to being in the same position as yourself, as the FOS are still trying to make them responsible.

    So contact the FOS and make sure with them, but you should be ok to complain about Allianz, it may take some time, the insurer does normally say no, but let the FOS sort this out for you now.

    Thanks as always...Fortunately I have copies of all my letters to M&S too and have the original FOS complaint form to send off. I have to call them tomorrow anyway as it is the date that HSBC were given by the FOS to respond to the adjudicators decision.

As the loan was unsecured I was not given the opportunity to not have the PPI and all the paperwork was filled in by someone else and I was just asked to sign.

    I have now forwarded everything to the FOS but am unsure if I will get anywhere....

    Good News I think...I originally posted the above in June as HSBC had finalised their decision and told me no to my claim. This morning I have had a telephone call from an Adjudicator at the FOS asking for some more information and she told me at the end of the call she was upholding my claim..I think this means that HSBC now will have 21 days to go with the adjudicators decision and repay the money or say no and go to the ombudsman which if they lose will be legally binding. I feel confident that if an adjudicator at the FOS says yes to my claim then that the Ombudsman may uphold the claim too. Either way I am more ahead now than when HSBC categorically said no to me

    Ok mixed news now,,,I have spoken to the adjudicator this afternnon as it was the deadline for HSBC accepting her decision and guess what ,,,they refused and still deny miss selling...so my case is now going onto the ombudsman for final presentation....here's hoping it goes in my favour but I expect this will be a long process as so any people are claiming...could be a nice xmas present though

    Usually from posts on here the Ombudsman would agree with the adjudicator and lets hope they do. Good luck and roll on Christmas for ya!!!

    2 years since first submitting my complaint to RBS (Direct Line) for PPI misselling, I have received a cheque from them after having gone through a very slow FOS (partly due to high level discussions with RBS which put all cases on hold) and an even slower Adjudicator. After this long wait the cheque was lower than expected possibly due to having a made a full and final settlement in Oct 2006 leaving a small balance to be written off which sort of ties in the with the shortfall. Waiting for them to get back to me with an explanation.

    Second claim (joint) won with RBS (same time frames) awaitng payment by RBS (dealt with a far more efficient Adjudicator). Not as big a win as Direct Line but every penny counts nowadays!!

    Eternally grateful for the help and encouragement on the forums and finally a partial success in the Direct Line case. Woop woop!!
