Really gutted - after waiting a year for an FOS adjudicator to look at my Tesco credit card PPI mis-selling claim, I have had a letter today saying they are not going to uphold my complaint.
The letter says that the FOS agrees that it was likely that the cost and benefits were not properly explained to me, but that it was likely that even if it was all explained to me, I probably would have taken out the insurance anyway. They also say that I ticked the form and so agreed to the insurance (which I did, but only because it was my first card and Tesco strongly recommended I did so).
I really thought that my patience would be rewarded and I'm gutted that it hasn't been.
I do have the option to ask for the case to be looked at by the Ombudsman and I will do that, but I suspect that it won't change the outcome.0 -

'You have received monthly statements detailing PPI..."
"By signing the agreement you confirmed you were happy..."
(despite the tick box that says You are strongly recommended to take this)
both of which are now being set out by the FSA in their new report as unacceptable reasons for rejecting.
Therefore I am intending to use the quotes from the new FSA report to challenge them. To quote from the FSA recommendations to the Dispute Resolution;
"The firm should not reject a complainants account of events solely on the basis that the complaintant signed documentation relevant to the purchase of the policy..."
I would refer anyone to this report and its r ecommendations as there is some really useful stuff contained which does strnegthen any claim made.
Finally those tick boxes, which have been frequently referred to in documentation both on here and elsewhere are extremely misleading. It is good that they have kept the original signed form though so I can see it and kind of them to send a copy to me as to reject it when those statements are clear to see only reinforces the view that we in all good faith accepted their Stong Recommendations.
I do hope that we start to see more proactivity on the part of these organisations in addressing the financial disasters that they have helped to creat.

i have the same copies of the paperwork too but am still waiting for an answer from allianz. keep us posted as the fos told me they would not investigate as m and s were not regulated at the time and i know yours and my complaints are at very similar times0 -

Yes we have, I wil llet you know and you keep in touch too. Cornhill who I said I had written to have not even acknolwedged, but M&S did which surprised me as they had rejected the personal reserve once, but we shall see.0 -
I've been lurking around these parts for a while, but I thought I'd register to post that after very nearly giving up when fobbed off after I first complained about my PPI (over a year ago) I finally got Lloyds TSB to accept they were wrong and cough up the £1200+interest on my £5000 graduate loan.
Many thanks to Martin Lewis and everyone involved in Money Saving Expert, as I would not have done this otherwise.

One month on, despite being told on the 16th July that the money would be in my account within 28 days, I still haven't heard anything more from Lloyds. So this morning I called them to ask what was going on.
They told me that "we have done the calculations, and processed your claim. They money should be in your account in 10 days"
Now, in reality it doesn't matter much whether I get the money they have owed me for 4 years back a month after they agreed they owed it me, or 6 weeks, but in principal I am really annoyed that it is taking a bank this long to put money they owe me back into one of their own accounts. Lets be honest, if I owed them £1000 and didn't give it back on time, they'd be sending out threatening letters and charging me for the privilage.
I am somewhat tempted to send them a letter telling them that I am charging them £50 in late payment fees and administration costs, just to see what they say.
Oh, and the best part of all this - their excuse for it taking so long:
"we've had over 4000 PPI refunds to process this month"0 -

So I would get this done with first (make sure you get your money back) then any charged pursue later on in case it stalls anything on your refund.;)

Just would like to post my success with Barclays bank for a personal loan with PPI claim.
Using the templates from mse i sent them to barclays bank claiming my PPI payments back from a loan that i took out 6 years ago.
Yesterday i received a phone call from barclays, confirming that they would uphold my complaint and today i received a cheque for £4661.87, this is the premuim of £3091.08 plus the interest that i paid on this of £774.86 and £1301.49 in interest on the payments at 8%.
I am currently persuing barclaycard and halifax as well for credit card PPI payments, i would recommend that anyone shud do this as i was surprised at how swift this settlement was agreed.
I started this on the 31 march and within 6 weeks i am happy with the cheque that i have received.:j:jHi Guys,
Just an addition to my last post success with barclay card, £3717 refunded for PPI payments from 1993...:T:T and £259 from halifax card so a good £8500 from them this year so far.
back onto Barclays for other loans and claiming back the PPI
Wahayy... another cheque arrived in the post today from Barclays Bank for a loan in 2000 the grand sum of £1160.52...this beings my tally up to £9798.52 from the Banks most from Barclays as well... and i have another 11 complaints currently on the go with them..0 -
Just wanted to let you know that Abbey/Santander are going to pay me £1,700 all for the cost of 2 stamps :j
Santander have actually (surprisingly) been the most helpful throughout and from start to finish it has taken less than a month. All the other loan providers I am persuing are all using stalling tactics (Egg and MBNA have been by far the worst).
Thank you to Di, Robbed, Amersall and all the other friendly people on this forum. I could not have done this without you.
I am going to go absolutely mental in Pizza Express tonight. Double dough balls for me0
