Do I need to e-mail them to ensure they tell me my expected voucher dates - it would be good evidence of due dates in Court (lets hot even hope that ever has to happen).I didn't do it, nobody saw me do it, you can't prove a thing!
Quidco and Topcashback, £4,569
Shopandscan, £2,840
Tesco Double The Difference, £2,700
Thomson EU261/04 Claim, £1,700
British Airways EU261/04 Claim, EUR12000 -
Here is the first claim form that my friend has received today (2 sides on 1 sheet)
Mira - was the value for the first part of the cash back correct on the form you uploaded?
I'm asking because my cashback was supposed to be £480 over 12 months - so in my mind that means £120 back at each of the 4 stages (months 6, 8, 10 and 12). Yet my claim form is same as your friends, with only £48 as the first redemption figure. Hmmmmm....
Anybody else notice this?0 -
Basics. It has nothing to do with guesswork or supposition. Follow the groundrules or don't; if you HAVE you will know (AND will be able to PROVE) precisely what the figure should be and assuming it's wrong (as looks likely - but THAT depends on the actual t&c and deal each person signed up to at the time and if they aren't 100% certain what that was then they're asking for it!) send a covering letter with the claim. If they pay a lesser amount than is due, send a LBA and then sue if they don't pay. I'm also not sure where "uploaded" comes from!
The figures here may relate to a cashback structure used by Phones4u. They have changed the structure a few times so (as always) it depends on the individual's t&c at the time they took out their contract. However, it is possible they have mixed up the t&c. If the figure is wrong and they are attempting to change the sturcture AFTER the contract was taken out the remedy is obvious (again) and simple.0 -

Agree totally. I have copies of everything saved when when the order was placed - the offer on the website page, the cashback deal, the T&C's, the installments etc. I can prove everything.
Having seen someone elses form looking suspiciously like mine, with a lower identical amount on it i was just flagging it here so that others can watch out for it.
I'm querying the total with M2YD right now and will update the thread when i get some news.mobilejunkie wrote: »I'm also not sure where "uploaded" comes from!0 -

Rang 21/1, spoke to M2YD via 01782 677600 (ask for M2YD customer services) - could also try 0800 072 5855
They explained that chequeback is now not in equal installments (despite it being so in original T&Cs),
It has been setup in 4 parts as follows (dates are for mine, yours will differ)...
1 of 4 (month 6) - 13th Feb 2008 - £48
2 of 4 (month 8) - 13th Apr 2008 - £96
3 of 4 (month 10) - 12th Jun 2008 - £144
4 of 4 (month 12) - 11th Aug 2008 - £192
So one slip with an early claim and you'll lose out on the big payments later - just be careful out there everyone!
Hope this helps.0 -
If they tell me that I'll simply send a LBA and then sue if they don't pay the correct amount. Why DO people bend to the convenience of companies at their own expense when they have easily enforceable t&c?0

Prepare for a fight - they set their stall out to do this from day one:
In the Ts + Cs they reserve their right to make changes.
Regarding cashbacks they say:Instructions issued and notified to you by us from time to time in relation to Cheque Back offers shall form part of these terms and conditions
And in the chequeback conditions they have this:Instructions issued and notified to you Mobiles2YourDoor from time to time form part of these terms and conditions. Any and all such variations will be deemed as though present at this time.0 -

They cannot change conditions that are detrimental to one party. It would hold no water if you took it to court. The Unfair Contract Terms Act etc may come into play.
There was a change in this promotion after a few days. Initially it was 4 claims of £120. Then they changed it and this was on the web site. It depends when you ordered as to what terms you are on BUT if at the time you ordered it stated you would would claim £120 (x4) then they are legally obliged to fulfill this.0 -
As I said - "prepare for a fight".0

Well, I'm happy for one if needbe. I do of course have the t&c printed out in full from the time and have checked them. It's not only an unfair term but also is talking about "instructions" (as in NOT sending you first claim the form when you order for example as in the t&c) and NOT amounts.0
