  • Given that it may well be another cashback dealer folded today I doubt you'll find a better deal in a hurry - provided you can extract the cashback!

    I have been looking at this phone from M2YD:

    As highlighted in an earlier post, as part of their T&Cs it says:
    "...Upon receipt of a claim form for a Cheque Back offer, we will verify such application for eligibility and may at our sole discretion refuse an application"
    This was followed up but I am still a bit weary of this. If I comply with all the t&cs and get all my forms sent off within the time period , and M2YD refuse to pay - If I were to take them to court to claim the money they owe, could they not simply quote this as part of the contract, thus making my claim against them invalid? I am sitting on the fence at the moment of whether to go with the cashback offers or not - could save a packet but could also end up dealing with a lot of c**p!
    Any advice on this would be appreciated

    My view is that if you followed all the conditions for the cashback and they refuse payment based on that clause then a county court judge would rule in your favour if it had to get that far.

    The easiest way of avoiding giving them this blanket "sole discretion to refuse an application" is not getting into bed with them.

  • BEFORE YOU COMMIT TO A CONTRACT WITH MOBILES2YOUR DOOR STOP AND READ THIS!!!!!!!! I am one of the regrettable customers to have passed my custom their way. I committed to a deal which involved me commiting to an 18 month contract with Orange on the Dolphin 35 plan (£35 pm). In return I would get a Motorola K1 and a free gift, which in this instance was a Playstation 3. I signed up at the end of July 07 and I received my phone and a starter pack within days, very efficient. Within the starter pack it advised me that my free gift would be sent 28 days after phone had been connected and then allow further 7 days for delivery. I estimated this to be the start of October. It is now nearly December 07 and I have yet to receive the free gift. At no point has mobiles2yourdoor contacted me to advise it is out of stock; if it has been sent and returned or any update on the status. Instead I have had to chase up and make numerous calls. Although the operators are friendly enough I have been fed hollow promise after hollow promise and I am invetiably told it will be with you next week. This has been the case on the last 5 calls I have made to them. I have issued a letter of complaint with a deadline to deliver the PS3 by. If it has not received I will be seeking advice. I have also opened a case with Trading Standards and passed on my story to BBC Watchdog. The deals are very good and tempting but I would seriously consider alternative retailers, if i was able to cancel the contract I would but I cannot because it is with Orange and not mobiles2yourdoor so I have no contractual rights with them. Sign up at your peril!

    My friend has today received her claim forms from M2YD. She was surprised to know that she needs to claim in 4 stages.

    The terms & conditions she signed up to only mentioned a claim at month 6.

    She phoned M2YD about the reason for this and the lady who answered her said that she is sorry about this and they had to change it because they can't pay a whole lot of money in 1 stage.

    My friend has told her that the only reason which made her sign to this contract was because it was easy to claim in only 1 stage. So now she HAS TO claim in several stages.

    So please advise whether she can do any thing about it? as they have varied their terms and conditions.

    Are they allowed to do this?
  • Despite what the t&c say about varying them - I don't think so. This came up with another dealer a while back. They can't change them to such an extent to their favour against yours. There are others on here who know contract law better and will no doubt give you better advice, but I wouldn't accpet that. What's to stop them changing again at month 6?

    I would very much appreciate a copy of the form though!
