    Just wanted to let you know that my money should have been with me on 9th August. I phoned yesterday morning and I was told that they have been asked to inform us that it is taking a little longer for the money to go into the accounts due to the backlog and volume of claims. I told them that it was not my problem and that should the money not be in my account today, then they are in breach of contract. I decided to leave it at that for the time being!
    Within an hour I had a phone call telling me that the transfer was made on Monday 6th August and had not reached my account yet. Today is Friday, and still nothing. Maybe I'm stupid, but a bacs transfer only takes 3 days doesn't it? I was told that it would be with me by next Wednesday at the latest?!

    Now I am asking myself, should I let it go until then, or make another phone call to the CEO?

    Anyway, if you call 0800 0154212, ask them to look at your CLAIM ACCOUNT not you BANK ACCOUNT. If the transfer has been ordered, then they should be able to tell you. I would also mention BREACH OF CONTRACT!

    The bottom line here is that Natwest are using the test case to hinder/halt claims are there appears to be nothing we can do about it. Even if you ring them you are likely to get told something different depending on who you speak to.

    I am sure that they are breaching the guidelines that are on the FSA website and they certainly are not helping to make the process any easier.

    Could anyone ask Martin if we can present all the goings on on this forum as evidence that the banks are actually using the test case to delay or hinder the claims that were prior to the 27th July??

    Really p******d off at the moment.

    I made an error in July and set up a direct debit from the wrong account. I went into my branch and spoke to a lady in there and she took the £30 charge off for me there and then. I have just received a phonecall from her to say that she has been told that she can't stop the charge as it was my error. She has gone above her branch manager to the higher bods and they will not budge and have slapped another charge of £28 on top of this first charge. So I am now going to be slapped with £58 of charges for one error. I can't believe it.
    I am going to have a good look through the board now and see how to go about reclaiming this money. If the charge had been fair in the first place I would have let it go and thought you live and learn.

    I too got the standard letter this morning stating tough luck - you have to wait. SO impersonal. I had sent them several emails claiming I wanted my case looked into under a hardship claim, but they completely ignored this. I have several months mortgage arrears and am barely making ends meet with utility bills and food (although we do not receive benefits). Can I claim under the hardship case or do you have to be in receipt of benefits?????????? Can I insist that they look into my case under the hardship case?????

    However Natwest have sent me a letter saying that they accept my request to have the charges paid back is 'lawful' and 'fair' however they then say that they won't pay the money back because of the legal proceeding which are going on between a number of banks including Natwest and the office of fair trading (OFT). Natwest claims in the letter that my 'complaint has been stored' and that it will be processed in full after the OFT legal proceedings.
    I get teh feeling I'm being fogged off.

    Advice anyone???

    First keep the letter from NatWest safe. Second write them a letter saying that if they do not repay the charges in 14 days yu will commence proceedings in the county court for recovery of the same.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
