Thanks Kez, can anybody advise me what action the court will take regarding Cobbetts appeal against the Striking Out Order, are they likely to reject the appeal or am I due in court?

Ok so some advice needed now.
My claim has been transferred to my local court now for early August. In the meantime i guess i'll need to prepare for the hearing now.
What are my odds? What do i need to prepare, sent etc. I have until 14 days before the hearing to submit everything.

I have received an allocation questionnaire from my local county court.
1/ I need to know how to fill it out correctly
2/ Part H of it asks for a "Fee" and reads "have you attached the fee for filing this allocation questionnaire"?
Is this the fee that i initially paid online when i first filed a claim of £120 on the HMCS website? or is it an extra fee i have to pay, and if so how much is it?
There is no indication of having to pay any extra i.e an attached note with the questionnaire that most people are mentioning. So does this mean that they are aware that i have paid the initial claim fee of £120?0 -

Dear Mr Lund
Thank you for your letter regarding the fees applied to your account
We are currently considering your claim.Given the work involved in assessing your claim we anticipate we will be in position to respond within 6-7 weeks, but will endeavour to do so sooner if we are able to.
Yours sincerely Stuart Higley
Does anyone have an opinion on this letter,or has anyone had similar,
6-7 weeks does seem to be a lengthy period of time.
Do i just wait until i get another response? Or are they stalling having a plan?
Any comments welcome,

The letters saying that they are investigating and will reply within 8 weeks are acknowledgements of receipt and attempts to make you give up and go away. The 8 weeks only applies if you refer your claim to the Financial Ombudsman because you haven’t received a reply.
Your first claim letter should give them 14 days to reply. If you have not received an acceptable reply by your deadline, send them the second “Letter Before Action” letter.
<O:p</O:pAt this point, you have to decide between referring your claim to the Financial Ombudsman and starting court proceedings.
If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. They charge the bank involved £400 for each complaint they accept. However, they cannot award interest like a court. Their success rate is good but, if the Financial Ombudsman is unsuccessful or the settlement is unacceptable, you can still start court proceedings.<O:p</O:p
If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, you can then refer your claim to the Financial Ombudsman.
If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.<O:p</O:p

You'll find a guide to filling out the AQ in the Reclaim Help Thread which is linked in my signature. At this stage there are further trial costs of £100 IF your claim is more than £1500 so if it is you need to send them the £100.0 -

In fact if you read through the posts on this thread those people who have given NatWest (part of the RBS group) the 8 weeks to complete their investigations have received an offer for their full claim.
Entirely up to you if you wait or send the next letter. You can of course send the letter threatening court but note the date from when you received the letter and phone the bank on the 6/7 week date and check what stage your claim is at.0
