    Thankyou Edinburghglass but i find it quite disappointing that no'one informs you about these court fees and costs prior to making a claim.

    i would think, not to worry. i sent my first letter ( well two seperate letters as i have two accounts with natwest) on 27th april 07. i then received a letter dated the 8th from the bank. it just stated that they were currently investigating and that they would respond as soon as possible.

    so, i sent my second letter on 11th may advising that i would claim through the courts if i didn't get a satisfactory response within two weeks.

    i didn't hear anything and was all ready to apply to the courts, but i didn't have the money. i planned to do it when i got paid two weeks later. then the first case in the courts where the judge found in favour of the bank was heard. what a blow it felt to all that were within this new phonominan. to top it off, there was that case where one single judge chucked out 20 cases in one go. even judgeas are cying out for a case to go through the higher courts so they have some guidance.

    so, i just sat on it for ages. not that i would advise this. i just felt so indecisive. should i take it to court or go through the FO, due to them doing it free, so no gamble with money, but also if they rule in favour of the bank, i could still take it to court, but if the court finds in favour of the bank, i think you have pretty much had it, unless you decide to gamble more money by appealing.

    i had just decided to go through the FO, printed off the complaint forms but still not filled them in and thursday just gone i received an offer. i couldn't belive it.

    i claimed £609 plus interst = £660.88

    and £2'609 plus interst = £3'202.23

    i was offered £3'002 and £609. I accepted. i sent the letter off on friday. i believe they have paid in full as one account was missing statements. i didn't need to order as i already had six years worth, with just a few missing. i never got round to ordering them. the other i had £400 of charges, due to a huge error on the banks behalf, paid into my account. the bank couldn't tell me exactly which ones, so when calcultating my claim, i didn't know what interst to take off. so the amount is about right. the form i sent back clearly states that they are not paying me charges back but rather paying me a good will gesture.

    my boyfriend did exactley the same with HSBC, everything was done on the same dates and he claimed for around £2'300. his offer came through today and was offered £1'588. he had also accepted and posted it back.

    several people on this webstie are saying that once they have aplied to the courts, they are getting offers and then don't know what to do. one person suggested to wait as they do seem to be settling.

    my father said that the other day he'd read that banks have just settled thounsands of cases as they are intentionally delaying it being heard in higher courts. they don't want the presidance set. if it goes in our favour, they have absuletely had it.

    i wish you all the luck with it and my feeling is that you will get it if you hang on. only you can make the call.

  • Hi, started my claim in March with Natwest, received no reply to first letter so then sent 2nd letter threatening court proceedings - last week had a letter back to say they were looking into my claim and would receive a response within 6-8 weeks, shall i wait this long or chase it up by phone?

    Also i am no longer with Natwest so if (!!!) i am lucky enough to receive my monies back how do they pay it back? By cheque or bacs to a seperate account?

    As long as there is no debt outstanding on the account if it is closed you should receive any money claimed back in the form of a cheque,

    I can answer this one to save time. If the account was closed by you and you are not paying any debt to the bank then you will receive the amount by cheque. If you aren;t then it will be amount owed minus claim equals what you get and in the form of a cheque. Hope that helps.

    I sympathise to an extent as I had to look long and hard to find out what all the costs would/could be. This shows how vitally important it is that if anybody is considering taking the bank to court that they read as much as possible. The guides on here and on CAG, and Moneyclaim.com have all the main details we need.

    ** HMCS Leaflet EX50 lists all the various court fees. This is a very useful leaflet indeed. Good luck.
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    I'm sorry if this has already been posted I am new to this site - I have an account with Natwest with a hefty overdraft. I have been umming and arring about reclaiming my charges but because of the overdraft I am frightened of them closing my account down and having to pay the overdraft immediately. Is this what happens or has been happening? I am totally totally skint!

    When I was claiming back from Natwest I gave them the 6-8 weeks to investigate.

    I would recommend calling them for the exact date they would be replying by, they can do this because they did it with me.

    I generally found Natwest to be quite good when dealing with my claim and after receiving a settlement for the full amount of £2860 they didn't downgrade my account or alter my overdraft facility.

    Please can someone direct me as to where to post a question - I can only find a space to type a reply in. Do I just type here? It's very urgent - I have to reply to NatWest's solicitors letter by Tuesday so I need to post it today or tomorrow and I could really do with some help.
