Can anyone help.... after learning ive had over £7000 taken off me in the last 6 years ive decided to try and re claim them off Natwest. I started with the usual letter asking for them back, after 4 weeks i got the you will hear off us again within another 8 with would take that up until the end of July. i then took advice of another entry on this site saying dont wait and send them another letter saying i never received a good enough response and if i never heard anything concrete within another 7 days i would start Court proceedings .... Now im getting nervous about the whole court thing... anyone help at all... Please.

Hi Im with Natwest & I stuck to the timings on here, I then proceeded with MCOL which is still on going...

You have 2 options with Natwest, give them 8 weeks & see what happens, the standard reply from them is to offer you your charges but without the interest.

This is what they did with me but it was after I started proceedings, my total claim was £1226 inc Interest, I then had to pay £120 MCOL fee, as soon as they said they acknowledged it I got an offer of £984, I said pay my MCOL fee & I will accept it, they refused so now I want the lot :D

Its up to you how you go from here, presonally if my claim was that much I would take the £7k & run, forget the interest as that is only awarded via the courts & your's could be tricky with it being so much.

If you dont fancy court or you get no joy after 8 weeks then get in touch with the FO

Well, thats 2 cheques in two days. It took ages. Was sick of waiting for replies and being messed round over phone. Going through Moneyclaim On-line and following MSE advice did the trick. Got 100%, plus interest, plus all court fees back. Thankyou very much MSE.

Well.... I'm still waiting. Went through MCOL - Natwest put in a defence, had to deal with Cobbetts...... still waiting for a court date locally. This has been going on 3 months now !!!
I wish I understood why some people get paid up in full and others are messed around like this.
Never again - its the FO route in future (for Halifax)

keep at it Pam . You cannot be any worse off in the log run. I also cannot understand the different approaches and I did settle for less as I was so stressed out with the process butyou have nothing to lose Be patient but it must be so frustrating for you

Cheers ripski - yes, frustrating is certainly the word!

Over the last weeks reading here, it's clear Natwest will settle up and repay charges if you give them the 56 days and don't go via the court route.
If you take them to Court, they frequently dig their heels in and defend, as happened to me.

I'm sure I'll get my money out of them in the end!

    thanks ripski

Ok i have got all my statements now - but i need to ask a few questions!

    1) - How many copies do i need to make of them?

    2) - When i do send them off do i send them the originals or copies?

    3) - Do i send all of the pages? (my charges don't start til 2002 but i have the statements from 2001)

    4) Can anyone remember the charge for an advantage gold account from 2001 so i don't try to claim them!

hi Pam. It's the amount of the claim. I had 2 small claims for around 700 in total. The solicitors quoted the grounds of financial viability when they sent the cheques out. I have to say that my experience was definitely that going through MCOL got a resolution. Natwest had messed me about and I did wait a long time. Funnily they sent a lousy offer by 2nd class which I got the day after lodging with MCOL.

hi Katie. What stage are u at? If u are sending off your claim, u dont need to send copies of statements. Just do an itemised list of what you are claiming back. As for advantage gold. It was £6 then upto £9. Good luck ;)
