has anybody recently BEEN to court vs NatWest.
What's it like?Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
Halifax 2: Ongoing....0 -
Hi all
I sent first letter to Natwest 28 April the second letter asking for full payment on the 17th June giving them 2 weeks to make full payment, I have now recieved a letter saying thay are currently considering the case but it will take 6-7 weeks to RESPOND:mad: !!!! i did threaten straight to small claims court as per MSE downloaded letter
what do i do now......
WAIT FOR 7 WEEKS TO RESPOND :mad:
or go
STRAIGHT TO MONEYCLAIM:eek:

I got the same response. I waited the 6 weeks and yesterday received an offer for the full amount of £2071. I'm going to check that they wont pay it into my account, remove the overdraft and leave me with nothing. Otherwise I'm accepting. I'm taking some cards through Moneyclaim but felt that I would rather not risk it with my bank unless the offer was not good. Hope this helps.0 -

i am wondering if i can write a response to this letter and say that there is not much work involved in assesing the claim, that i have done most of the work for them already, and dont feel 6-7 weeks is acceptable , i would give them 7 more days to complete a full refund.
or phone the Natwest Litigation Dept and talk to someone to sort it out ASAP?? i think i read a thread somewhere where someone had done this and settled on the phone can anyone help with a correct phone number for Natwest????
Also can anyone help my wife had a credit card which she maxed out at 750 pounds due to fees now the debt is 1400 and has been sent to a HFO Capital Ltd a debt collectors??? not sure ? the fee reclaim works for credit cards too i thought do i have to start contacting the debt collector or original cc company to get full acc statement and start charge refund proceedure

As you threatened to start court proceedings, gave them 14 days to reply and you have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.The acquisition of wealth is no longer the driving force in my life.0 -

It is a kind of bullying. However, if we stick to the path, we eventually get our dosh back! I have found the help / court threads here and on CAG excellent.

I disagree that it is the amount of claim.
I commenced about the same time as Pam and went MCOL route for approx £7500
Nat west defended and I got the standard defense from Cobetts .Then trasferred to my local court for a hearing date ,when I got an offer of nearly £6000 out of the blue which I acepted as I was stressed0 -
Had court date through today - 3rd September. The court has asked for the allocation fee of £100 even though the allocation questionnaire has been dispensed with.
Thing is, it says - and I quote
"Each party shall deliver to every other party and to the court office copies of all documents(inlcuding any experts report) on which he intends to rely at the hearing no later than 14 days before the hearing!
This I assume is the court bundle we keep hearing about?
It then goes on to say we must file with the court and serve on the other party our own witness statement - is that basically an account of what we have done so far, you know, sent letter to bank, got negative response, sent 2nd letter etc?
The notes for guidance on the making of a witness statement says that:-
It must NOT be a bundle of relevant documents,
However the last bit says that we should attach any relevant documents.
Bit confused - any help would be appreciated.
Also now I've got a court date, would it be worth contacting the bank once more to see if they want to settle before court. Am thinking that if they settle before I have to pay the £100 allocation fee, then it'll save me having to claim it on top of the rest. What do you think?
Oh and by the way, just to give everyone some encouragement, decided to get the financial ombudsman involved with a claim against Nat West credit card - took a couple of weeks, but result - got offer today of £30 short of what I asked for, and this was so simple. Completed the relevant form, sent it off, had response letter saying we're looking into it, and then today got offer. I am definately a happy chappy - today at least!0 -
Hi, just received Defence from Cobbetts and a Request for Further Information. Is this standard and what should I do next - feel a bit nervous about what to do? All through process not heard a word from Natwest just the Defence. I am acting on behalf of my partner who is owed just over £5,000.00 including interest. Does anyone know if small claims procedure applies if claim only goes over £5K due to interest claimed.
Any advice would be really appreciated as I am feeling a bit daunted now!0
