    Absolutely Pam. A good friend of mine is working on Halifax claims. It seems there's a bit of pot luck involved on who deals with your claim, and how pressed they are on that day with targets. They have to clear 'x' amount each day. Most of them are contractors too. I would imagine it's similar when the legal people get involved with court claims. But sharing our collective knowledge here, and reading through Martin Lewis' words of wisdom (essential) can help us greatly. It's like a poker game now. The banks want us to believe we aren't holding any cards. Bluff, then counter-bluff?

    Message to everyone is; don't be bluffed or bullied. However, if you feel that you have been made a reasonable offer and don't want to go any further, then settle. Especially when it's a good few grand which is life changing money when you are in debt.

    Finally, I think it is more important than ever that we get the wording on our letters spot on, and that we follow correct procedure. I am sure that when a case falls into the hands of the litigators they will pick up straight away on any potential flaw in our case or weak-spot they can find.
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    Can I just ask again about this:

    Some of us have had letters stating it will take 6-7 weeks to sort out a claim. Do we let them have this long, do we wait the 14 days then go straight to MCOL, or do we send them a letter saying it isn't good enough?

    I think its your shout Mechanicus. You have the right to to go straight to MCOL, however from what I have been reading they do seem to offer after this period.

    If you have sent 2 letters, giving them 2 weeks on each... 4 weeks in all, then you can quite reasonably go through the Moneyclaim on-line process. You could try ringing Customer Relations and say that you wish to resolve the matter but require an acceptable offer to do so... otherwise you will lodge a claim or go through the Ombudsman. It may work. If not, you have the other 2 channels open to you. Neither are quick, but they can be very effective. Read the success stories on here to see how many people have got what they want. Keep your nerve and keep posting and let us know how it goes.

    Ring them on the number on the letter to clarify what period the offer is for. They do take ages to respond to claims and are not as organised as we may wish them to be! If it's for the 1st part of your claim then great. Accept and continue for the rest. If it's for the lot, then you can write back and say you accept that as 'partial settlement' and will continue proceedings for the rest. There are templates on here to use. Good luck.

    The RBS quote is interesting and may well be the case . My experience is that the only consistency is the inconsistency
    For instance - I tried phoning and negotiating by phone but got zilch /nowhere yet others were able to negotiaite by phone
    Cap One have been willing to enter into communication but only to really say 'bog off' so it is off to MCOL again who must be getting cheesed off with the extra work

    i sent my 1st letter to natwest on 18th june 07 and received their usual looking into it in 8 weeks response on 29th june, i sent my LBA on 2nd july 07 then today i received a full and final offer from them for £1430.00 my claim is for £2743.00, this offer was dated 2nd july 07, i will not accept the offer, but do i wait to see if they respond further to the lba or wait the 14 days before using mcol - the letter also states that should this outcome not be satisfactory i should telephone their offices within 8 weeks.

    any advice please

    I'd give them a ring to see if you can negotiate a higher offer with them ;) Don't give them anymore time than you should, stick to your timescales

    it seems as though the offer came from my 1st letter, i dont know if this is normal tactics, would they be likely to make a different offer after receiving my lba letter ? or is just one offer the norm for nat west.

    I decided to ring the complaints departments on tuesday regarding the above I got my cheque this morning Oh my god. I am now debt free as this was my last dept and I am now £2400 richer. I am off on a weekend retreat to get over it all next month courtesy of natwest. Thank you so much without this website I would still be dealing with the debt collectors trying to pay off the £3000 debt and good luck to everyone still trying. It is amazing how one website can make such a diffrences in peoples lives.

    What the devil is the CRP Part 18 and Part 27 they refer to? Can I read about it somewhere here? Also when I send them my calculations which I did using :money: 's calculator it obviously did not give a description of each charge as shown on my statements - do I have to redo the calculations and type each charge in as they request? :rolleyes:
