I too have received the standard "...respond within 6-7 weeks..." reply from Natwest.

They have 6 days left on the 14 day limit I gave them. Should I just wait it out and go to MCOL on Thursday, or send them another letter saying that it is not good enough and they have 6 more days?

I have only posted on here a couple of times but thought would let you know that I have received letter from Natwest offering the full amount of £7.4k. I'm sending form back today so hopefully in 10days time will be a little richer! :j

Good luck to everyone still waiting.

Anna, as you arent feeling so brave I will show you the template I used in response to the exact letter you have, its a combination of what Martin & others suggest on here:

    Dear Sir or Madam

    Re: Claim No:

I acknowledge the receipt of the defence dated xxxx 2007, posted on behalf of National Westminster Bank plc. I have already detailed the charges which were sent along with my letter dated xxxx 2007, I am also concerned you are dealing with this case without having kept the original paperwork related to the claim. To confirm the charges please find enclosed a full detailed list to assist you.

I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative, furthermore I consider that the CPR part 18 request is intimidatory and I intend to bring the intimidation to the notice of the court. However, for clarity I confirm the charges I am claiming were applied to the following account:-

    Account Name:
    Account number:
    Sort Code:

    Yours faithfully

Dont panic about what they send you, just come on here & have a look in the threads Pam suggested, if you cant find an answer just ask :)

    [/quote

What the devil is the CRP Part 18 and Part 27 they refer to? Can I read about it somewhere here? Also when I send them my calculations which I did using :money: 's calculator it obviously did not give a description of each charge as shown on my statements - do I have to redo the calculations and type each charge in as they request?

Gareth - here's one from me  ;)

Yes, I'd agree. My claim is for a little over £900 - I can't believe its financially worth their while contesting my claim in Court. There doesn't seem to be any pattern, to me - I think they probably pick a few at random to use their bully tactics on, whatever amount is being claimed.
Cobbetts must be rubbing their hands in glee at churning out these 'defences' - they must be making money hand over fist out of Natwest :D

To anyone dealing with Cobbetts, check out this thread - and this one too - lots of helpful advice there on how to reply to the solicitors letters.

    Pam
hi Pam. Sorry to hear that you're being messed about. There does not seem to be much of a method other than to scare and intimidate people. It also may partly depend on who gets the case at their end. Where they are with their targets etc. They'll have to pay you eventually. Hope u get it soon. Best wishes.

I disagree that it is the amount of claim.
I commenced about the same time as Pam and went MCOL route for approx £7500
Nat west defended and I got the standard defense from Cobetts .Then trasferred to my local court for a hearing date ,when I got an offer of nearly £6000 out of the blue which I accepted as I was stressed
Hi Ripski. I had intended to be as helpful as possible when making my post. Given that I have had a lot of success. I wanted to share my experience with this forum without which I could not have done it. I'm pleased for you that they paid up. Thats a huge amount of money. Well done!

Just to clear up the issue of amounts. This may well be of interest to people reading this thread. I quote from the letter I received from the RBS Group Litigation: 'We believe the the particulars of the claim disclose no reasonable grounds or cause of action against the bank. However, we believe that given the amount of your alleged claim, it is not commercially viable or cost effective for the bank to defend the claim.

My claim was only £386. Agree or disagree whatever, but the above quote is from an RBS solicitor.

I am no expert on here. I just want to share info and experiences. I will make no further posts on this subject as I don't want an argument. But I feel it's important for the facts to out there where we have them.

    Sincere best wishes to you.

  • I have commenced court proceedings via the website against NatWest and they had until the 14th July to respond. They today sent me a letter (looks automated and impersonal) stating that their unauthorised overdraft fees are not penalties but charges for their services.

They offered £206 to settle - my claim was for £1.7k!!!

What do I do now? Do I ignore it and enter judgement or should I fire off another letter saying that I don't agree and am willing to take it to court?

I'm scared. What if it goes to court and I lose?

I am in a bit of a sticky area with NATWEST. I wrote my initial letter to them about 8 weeks ago claiming about £2500 in charges dating back to 2004 (i had statements to this date). I gave them 14 days to respond after which i said i would claim back to 2001 using the statemnts they were sending me. I send 5 subsequent letters claiming all the charges back to 2001 amounting to £6100. I received a letter today offering £2500 which is clearly in relation to the initial letter. Can I ask for the rest or is this the final offer they will give?????

Have they have 'acknowledged' the claim. They will have 28 days from the 'date of service'. You should have had a letter from Northampton County Court with a copy of their acknowledgment. It's up to them to file a defence before the deadline. I don't think you have to respond to the letter they have sent. You could ring and haggle for more. But don't be pushed about by them. It's an attempt to intimidate and scare you which is very common now. You might get an improved offer, or when it comes to 'Judgment Day' go to the Moneyclaim website and file for Judgment. Keep your nerve. And keep posting here if there are further developments.

Hiya skint.. glad you're getting your money back  It's good that everyone shares their experiences and information etc - it also goes to show how disorganised the banks are in dealing with all our claims. You contribute a lot of helpful info here, so I hope you'll stay here. Trouble is with forums, its hard to write it all out sometimes - I often think 'if i could just say all this, it'd make so much more sense instead of trying to type it and missing out half of what I wanted to say'

    all the best!

Ring them on the number on the letter to clarify what period the offer is for. They do take ages to respond to claims and are not as organised as we may wish them to be! If it's for the 1st part of your claim then great. Accept and continue for the rest. If it's for the lot, then you can write back and say you accept that as 'partial settlement' and will continue proceedings for the rest. There are templates on here to use. Good luck.
