    Rang again today. Another different member of staff, who told me my call on Wednesday had been logged as requesting another letter. She went through the spreadsheet showing letters on order & its not on there. She claimed this could mean a letter has been sent as it only shows pending letters, but there was no way of telling.:rolleyes:

    I then requested the procedure to send a letter & told it goes through about 5 different people, one to request it, one to check it hasnt been sent, one to check the details again, one to check I havent already been paid & then another quality check....for one letter they have allegedly already sent:mad:

    She is requesting another duplicate, so another 7 days apparently.

    Off work next week on holiday & had been hoping for a little windfall to enjoy myself, but doesnt look like its going to happen does it:(


    Another 10 days passed & still no letter. Spoke to RBS on Monday & she investigated & actually called me back saying one had been ordered on the 18th & I should wait until today, but instead rang Thursday to be told it was ordered 25th & issued 26th.

    I accept there was a 1 day post delay, but even 2nd class you would expect it to arrive today.

    At the end of my tether now. Appears I get different info every time I speak to them, but every time they confirm its been validated, so I dont want to jeopardise anything by instigating court action.

    Dont know what to do anymore, it is now 32 days since they said the original letter was ordered. I have had at least 6 people say they will reorder it. 3 people give me different dates of it being reordered & still nothing.

    Any suggestions?

    I have decided not to fight with the natwest any more and just get my charges back which comes to over £5400 without interest. I know I am wimping out but I did not realise till 2weeks ago how angry and upset I was getting about the whole thing . Life is just to precious to waste time on them.
    But a word of warning to anyone who are claiming charges and there natwest account is frozen and with the credit management service (still a part of natwest ) They pay the charges into your account then you have to wait 10 working days for your account to be inactive ( although mine has been frozen for 2 year apparently this does not count ) you then have to wait 3 weeks for them to send you out the cheque but there is a delay of an extra two weeks due to the backlog.
    So I feel back to square one like I have been coned as I have the money but can not get hold of it and once again I am so angry and upset.
    Fatwest just keep getting fatter

  • I've followed the process through to the letter threatening Court action. Natwest now say it will take 6-7 weeks to respond to my claim. Has anyone else experienced this and if so what did you do and what was the outcome?

    The letters saying that they are investigating and will reply within 8 weeks are acknowledgements of receipt and attempts to make you give up and go away. The 8 weeks only applies if you refer your claim to the Financial Ombudsman because you haven’t received a reply.

    At this point, you have to decide between referring your claim to the Financial Ombudsman and starting court proceedings.

    If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. They charge the bank involved £400 for each complaint they accept. However, they cannot award interest like a court. Their success rate is good but, if the Financial Ombudsman is unsuccessful or the settlement is unacceptable, you can still start court proceedings.<O:p</O:p


    If you choose to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, you can then refer your claim to the Financial Ombudsman.

    If you choose to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.<O:p</O:p

    From my personal experience with Natwest I decided to allow them the 56 days to respond although it was clearly outside the timescale set.

    Literally on the 56th day the responded with full settlement of my claim.

    They also reimbursed me the charges I had incurred whilst going through the process after I added a note requesting these.

    They did'nt downgrade my account and left my overdraft facility in place.

    Its entirely up to you but if you call them and get confirmation that they are willing to settle for the amount you are happy with, I would wait.

    I wrote to natwest last week to request the list of charges etc, and i got a letter back in the post yesterday dated the day after they got my letter saying they were being sent.
    Friends are angels who lift us to our feet when our wings have trouble remembering how to fly.
  • I am currently trying to claim £3029.00 + £263.39 interest total £3292.39 unfair charges from NATWEST. I have today recieved an offer of £2280.00.
    We are undecided on the best course of action. Do we accept the offer or do we hold out and seek court action.
    Any advice would be appreciated:confused:

    I was told by natwest 2 weeks ago that an offer had been made for the full amount, which included interest. I then called a week ago for an update and the lady i spoke to said an offer had not been made and she did not know were the offer girl got the amount from. I explained that i had not told lady I was talking to how much the claim was for, so there for I was sure she just had different information. I went on to send an email to someone higher up, I recived a email yesterday to say my offer was in the post. Not quite sure what to expect now as it seems that natwest dont pay out interest?!!

    It's entirely your decision but I would push them for more. They haven't offered you £2280 out of the kindness of their hearts. However, it's quite a clever offer as it's around 2/3rds of what you want. I know u will be afraid of 'risking' it, but push for more mate. Prepare yourself before u ring them and squeeze a few more hundred. How about saying 'we meet half way - i.e. between the offer and your claim - and u have a deal'. Then you have got more and the person at the bank can say they have a result too as they will almost certainly have to pay u in full if u went to court.

    If you did push through the court though, as it's a big claim they will try and scare u, saying they will defend etc. Solicitors writing to u etc. It's all part of the game.

    Natwest have just sent me a nice cheque for nearly £400. Funny really. If they had been sensible they could have got away with half of that. My original claim was only £250. However, they offered next to nothing, so I went through MCOL. They said they would 'defend the whole claim'. Two weeks later I receive a cheque for my full claim plus an extra £100 interest and costs too. They have said that though 'I have no case in their opinion... it is not financially viable to continue...' Nice of them.

    Proves if you stick to your guns and don't be messed about with all this 8 weeks garbage, you can win. Just read all the success stories on here for a bit of food for the soul.
