  • I am still no further? I couldn't find the template/s on the home page. I did read the fact that the FSA has given the banks that are in proceedings with the OFT the right to 'waiver'....!!!! which means that they don't have to respond to complaints apparently! and they probably hope the court cases will follow suit?! Therefore, it isn't the right to 'waive'- but to fog us off! and how do they get the right to say in the letter that the fact I want to reclaim the charges is 'lawful' and just, yet they want to 'waive' my request when - if they think it is 'just' and 'lawful' - they should deal with the request straightaway. Surely-logically, the fact that they want to stall for the legal proceedings to finish and that they've admitted my request for the charges to be refunded is 'just' and 'lawful' then supposes they are therefore purposefully (with permission of the FSA I might add) stalling and hoping after the proceeding have come to a close they don't have to refund the charges.
    I need to know what other people are doing in this situationa and if there is a template in the making or already on the site i havn't found yet.

    I applied to my bank to reclaim my bank charges at the end of July 07. I have just received a letter from the bank (Natwest) telling me they are unable to continue with this "complaint" as they are now "involved in Legal Proceedings with the OFT in relation to Bank Charges and Customers trying to reclaim them back...."

    Does this mean I am no longer able to reclaim?


    Or Can I still fight this in order to claim back the numerous charges the bank has made to my account?


    Please help... Reading the jargon that the bank presented me with in this letter, has made me feel like I have no choice but to forget about even thinking I will be entitled to the reclaim of charges. :mad:

    You can still claim back your charges...whilst it is true the banks no longer have to deal with anymore claims they still have to log it, depending on how far back you are claiming it is maybe worth filing your claim on mcol
  • Miss 1 - I don't know much either but don't give up - it's your money. Maybe you should put a claim in the court now - what do others think?

    What is the general consensus now with the ongoing legal battle with banks and the OFT??

    Should people still try and claim or wait on an outcome from this. I am about to send off asking for charges back from Natwest and not sure wether to go ahead with it.

    It depends how close to the 6 year cut-off mark your charges are. If they are, you need to get your claim in the system now to avoid getting time-barred.

    Hi, I called my Court yesterday to discuss the case as I have a date for October for my charges against Natwestof nearly £6500, and they say that a general stay has been placed on all the cases and that I have to pay another fee of £35 to have to court look at it again, is there anything I can do with Cobbetts or Natwest to move them?

    I've got a Court date for mid September - not had any communication to say that my case has been stayed, but am quite sure it'll arrive any day soon :rolleyes:
