  • I have received the defence that NatWest have filed with the court, this morning. It's full of allsorts of legalese and, as far as I can tell, they seem to be wanting me to provide all the evidence that will make their case for them.

Has anyone else had this, and what do I do about it?

You don't need to reply to their defence but if they ask for your list of charges then send that to them.

You'll find a thread called Letter from bank/solicitor during court claim, it is linked in the Reclaim Help Thread, which tells you about this.

Got a cheque for £1,762 from Cobbetts on behalf of Natwest today. I'm claiming £1,780 plus £280 interest plus £120 court costs. Along with the cheque was a cancellation form for the court process (I have a hearing on 20th Sept) and I have to agree not to disclose information to a 3rd party.

Can I still bank the cheque, say thank-you for the part payment and carry on through the courts for the rest (not too botheres about the interest but would like my court fee back as this could have been settled some time ago)

Just not sure where I stand in terms of legality of banking the cheque and telling them to stick the confidentiality etc up their backsides!!

    Any help much appreciated!!

So, anyone know what my position is here? Can I legally accept the cheque as part payment or am I just being greedy considering the current circumstances?! Either way a donation will be winging it's way to this site as, without the help on here I wouldn't have got this far!

to be honest i think it would be greedy, unless you send them the cheque back.

In view of all that's happening, I'd personally take the money and run! Seriously. :)

Yes you can press ahead with the small claims court
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
