:T Ohhh keep us posted! Sounds like Newark have decided to really pin them down - test case or no test case.
I hope the Judge at my local County Court decides to do the same with my pending case (Sep 27th).
PamBeen following the advice of this site and have been batteling with cobbets solicitors as they put up quite a scary defence. Claiming 2,800 ish from them, they initially offered me 2k as a good will settlement which i refused.
But
Had this in the post today from Newark Court. I dont fully understand what it is asking the defence for but think its looking a bit better for me
IT IS ORDERED THAT
The court of its own motion is considering striking out the defence in this action as an abuse of process.
The basis for this is the fact the defendant is settling all claims of this nature where claimants are seeking reimbursement of bank charges, with no claim proceedings to a contested hearing.
The court considers the authority of Mullen -v- Heckney London Borough Council (1997)2 A11ER 906 relevant.
If the defendant objects to the proposed strike out it is ordered to file, within 14 days of the date of service of this order, a schedule setting out all claims of this type in England and Wales which have proceeded toa final contested hearing, and the outcome of such hearings, together with a schedule of all such claims which it has compromised before final hearing, after proceedings have been issued.
Upon receipt of any such objections the court will consider listing the claim for an on notice hearing of the strike out issue.
In the absence of any such objections being filed in time, the defence herein will be struck out and judgement entered for the amount claimed by the claimant, together with the appropriate costs claimable on the small claims track.

Yes it certainly looks that way, I don't know what Natwests solicitors can do now they have the order, it seems alot of work to provide in 14 days. Or how the test case will affect it !! But ill certainly keep you informed0

A few courts have been sending this out to different banks and yes its good news for you especially as the court have sent this out presumably before last weeks announcements.0

There are two dates on it, 23rd July & the 26th July 2007 next to the stamp in the box with claim number etc. Will they have to honour it as it was prior to last weeks announcement ?? Hope so

Not sure if this is the right thread, but I'll ask anyway - have just paid visa bill (natwest) 30/7/07 and been informed that will have 12 quid charge on bill for late payment - is it my fault that the bank are so dog slow that it takes 3 days to go to visa? Technically its in the terms and conditions (3 working days I believe). It does pee me off though that they're charging me roughly 25 percent on a £40 visa bill - for their 19th century system. I have called Natwest Visa but they were nice but firmly useless, saying it was between the bank and myself. What do the experts here advise? TIA.0

My first post here - can some one help me out. Natwest received my request for a refund on 7th June and therefore I have now been waiting for 7 weeks. Yesteday I received the following email from them:

This was sent on the day of the OFT ruling at 1530 and says my claim has ben verified and an offer letter has been prepared - will this count the same as them making an offer and therefore likely go through???

- Hadn't received offer letter today so phoned again and was told that there is now a standard letter being issued.
Do you think the email stating that my offer is prepared and will be sent out actually constitutes an offer or am I now stuck with the waiting game that is the 'test case'
If anyone else has been through anything similar have you had an offer yet??

Many of us have rung CS in the past and been told that offer letters were being sent out.... which never materialised. At least you've got an email from them to confirm that they were sending an offer letter out - I'd think you should be able to pin them down to that? I hope so.

I could do with some pretty urgent advise. I have a court date coming up in a few days. I've had my bundle sent off to both the courts and Cobbets. I had a message for me today from a Cobbets lawyer asking to give them a ring back. Not quite sure what it is or if my case if affected by the recent news of the test trial.
If anyone could shed any light? I'll give them a ring tomorrow but with the case so soon any other advise to prepar for the case would be handy.

Do I need to inform Natwest that I am taking my claim to court if I had received the 6-7 weeks letter around 20th June and obviously nothing since? Do not expect to hear now! So do I have to give them the remainder of their timescale or just file my claim? Thanks.0
